If I recall correctly, Mike Lee said that in order to “have valid standing” in a legal action, that

My assessment is that the falsification – or the obvious inaccuracy of the Hoopili EIS, will result
in the likely loss of habitat to the Pueo. The entity that is specifically “hurt” is the Hawaiian people,
who will lose their family Aumakua. In addition, the Pueo is “protected” as a recognized State
Endangered species.

Nā ʻaumākua were worshipped at localities (often rocks) where they were believed to "dwell". The appearance of an animal one regarded as an ʻaumakua was often believed to be an omen (of good or ill). There are also many stories of nā ʻaumākua (in animal form) intervening to save their descendants from harm. It was extremely bad luck to harm a manifested ʻaumakua.

Despite this, for pueo populations, the following are of particular concern:
“Sick owl syndrome”. Mortality on Kaua‘i has been attributed to this syndrome, which may be related to pesticide poisoning or food shortages.
Predation. Because pueo nest on the ground, their eggs and young are vulnerable to predation by rats (Rattus spp.), cats (Felis silvestris), and the small Indian mongoose (Herpestes auropunctatus).
Habitat loss. May be particularly important to O‘ahu pueo populations.
Contaminants or toxins. Because pueo are top predators, fat-soluble contaminants may accumulate in prey species; may be related to “sick owl syndrome” (see above).
Human interaction. Hunting behavior and habitat use predispose pueo to vehicular collisions, which have been documented on Lāna‘i and the island of Hawai‘i.
If the current situation is allowed to continue (loss of habitat), it represents acomplete FAILURE of Hawaii’s Comprehensive Wildlife Conservation Strategy.
So I cannot understand how: During the public review period (for Hoopili), the State Department of Land and Natural Resources, Division of Forestry and Wildlife
wrote that it had no objections to the proposed project.
That is a complete contradiction.

It is time to take a wrecking ball to the unsustainable to build and unsustainable to operate 19th century CHOO CHOO and start from scratch with a modern, 21st century, lower footprint, much lower cost to build and much lower cost to operate and maintain monorail / maglev system. Has ANYONE even done a long term analysis of the cost to dismantle, rebuild, operate, and maintain 21st century technology instead of 19th century heavy rail technology?
The CHOO CHOO was obsolete before it was even hatched by Goofy Mufi.
With all that is going on at the IUCN conference this week, it is unconscionable for the FTA to force the city to stay on the same destructive course with an unsustainable rail system and continue the mass financial rape of our people just to save face, to save their own okoles from having egg all over their faces.
Highly successful Honolulu attorneys should be stepping up to the plate to give back to the community with pro bono work like John Carroll ( running against Schatz ) has done by filing more lawsuits against the city and the State Supreme Court for their unconscionable and negligent actions.
As IUCN panelists have pointed out, the financial burden will be passed down to the children of today and those of tomorrow, being taxed from the day they are born until the day they die because of numb skull, knuckle head, nincompoop, screwups and f'ups like Caldwell, Goofy Mufi, the entire City Council, and yes, even our Legislature.
Will the Legislature simply continue to rubber stamp another bailout of the city like the Fed bailed out similarly fraudulent and criminal Wall Street banks without holding city officials accountable for their crimes by putting those responsible for the fraud in prison for their mass financial rape of our taxpayers?
Heads at HART have rolled. So too should heads roll at the city council starting with Pinocchio ( Ikika Anderson ), and Caldwell in November.
However, Mr. Djou is no better than Caldwell. We need an outsider, a non-politician, an underdog like Ron Hochuli, to take the helm and try to steer our rapidly sinking ship in a better, more sustainable direction.
Let's get rail back on the ballot in November to get an unbiased and complete picture or poll of opposition or support for the CHOO CHOO. Polls are meaningless to me, and they can easily be slanted in the direction those paying for the poll want it to be in order to sway voters in their direction by carefully choosing the demographics for the poll. The only true and accurate poll is in the voting booth.
Our city and state career criminal politicians continue to play musical chairs going from one position to another and rarely get dumped into the manhole to the sewer below where they belong with their lack of ethics and lack of morals.
Will we, the taxpayers continue to be screwed, to be financially raped by money grubbing politicians who have no shame, who have no soul or who have sold their soul to the devil for 30 pieces of silver, who have no scruples, who have no ethics or morality, who are negligent, incompetent, and downright reckless with our money? If they managed their personal family finances the same way as they do the taxpayer money, they would be bankrupt and divorced.
Our endangered Pueo Owl and even Jane Goodall's Chimpanzees have more intelligence than our mentally challenged Neanderthal-like politicians who are destroying the aina and the financial stability of every man, woman, child, and unborn child in Hawaii all for the love of their false god, MOOLAH, that they value above life itself. They would sell their own mother for 30 pieces of silver if they thought they could get 30 pieces of gold in return.
It is time to pull the plug on the obscenely expensive to build and operate, and fraudulently conceived 19th century CHOO CHOO, and protect the aina before it is too late to reverse the damage, by preserving 33% of Oahu's prime AG land capable of growing 4 to 6 crops a year, and relish the beauty of nature that is the Pueo Owl that has no voice in our broken, f'd up legal system.
The hypotenuse of a right triangle is shorter than the total distance of the other 2 legs. Thus, the shortest distance to downtown from Ewa and Waianae is along the path of a ferry route that was tried once. The SuperFerry was rejected primarily because it would cut into the profits of another monopoly much like HECO, Hawaiian Airlines. It is time to resurrect the ferry in the spirit of the IUCN conference - Planet at the Crossroads.
Will the city continue to be negligent by arguing that it is acceptable and legal ( by whose ethical & moral standards?) to run the CHOO CHOO through known flood zones and tsunami inundation zones because the EIS ( an atrocious lie in itself ) was completed and approved BEFORE current maps were released by the UH?
Maybe someone needs to start an adopt a Pueo campaign like Jane Goodall's folks who adopt a chimpanzee or a gorilla, but I for one would never adopt a Neanderthal like the ones who are running our city, our state, our country, and our world into the ground and into oblivion all for the sake of MOOLAH.
I'm ashamed of what fighting Goliath ( our fraudulent, criminal utility monopoly, Hawaiian Electric ) for 5 years without accomplishing anything to slay Goliath and bring about non-profit power, has turned me into, a hard core cynic with virtually no trust for any politician anywhere. They all speak out of both sides of their mouth, saying one thing to get elected, and doing something else once elected to satisfy the needs of their puppet masters for their insatiable lust for MOOLAH.
But listening to the IUCN meetings on Olelo has given me renewed hope that humanity will survive to see the 2nd half of this century with the help of the young people who will force the old fogies in power to do what is necessary to save nature, including the Pueo Owl in Ewa, or, be forced out before they destroy all of humanity and Spaceship Earth, the little blue dot.
Finally, let's not lose sight of the fact that the expansion of Papahanaumokuakea not only violates indigenous fishing rights for Native Hawaiians, but is very likely not about protecting the environment at all, but about US Government federalization and militarization of the Pacific in support of the yet to be passed TPP trade agreement designed to remove barriers to profits for those countries signing the TPP agreement.
The TPP will likely circumvents the Jones Act that Hawaii, Guam, Alaska, and Puerto Rico have tried for years to eliminate because of the 20% to 30% increase in the cost of food and products shipped into Hawaii on Jones Act ships.
In other words, the expansion of Papahanaumokuakea is not likely an altruistic act by President Obama as it appears to be on the surface, but is more likely an attempt by the US Government to hide its real intentions to expand and extend its military reach and control throughout the Pacific.
And this will be detrimental to food security for the people of Hawaii, especially for native Hawaiians who had their monarchy and lands illegally taken away from them by the US Government on January 17, 1893, with the full support of our fraudulent, criminal utility monopoly, Hawaiian Electric.
Now, the US Government is stealing 60% of Hawaii's exclusive economic zone primarily for military purposes and TPP partners without any compensation to the state of Hawaii and its indigenous people.
The US military is not subject to the Jones Act, and spends a lot of time in the monument fishing to feed its crews.
Is the US Military required to eat all the fish they catch while in the monument ( Sustenance fishing ) as Native Hawaiians are required to do as part of the expansion or is the US military allowed to bring fish home to Pearl Harbor or anyplace outside the monument ( subsistence fishing ) to continue feeding its family ( crew ), something that native Hawaiians are not allowed to do under the rules of the expansion?
Nothing is ever what it appears to be when politicians leave out critical details and speak with a forked tongue on the world stage.
Maybe the canonization of Mother Teresa as a saint by Pope Francis on Sunday will have a ripple effect on those on dare to continue worshipping their false god, MOOLAH.

I'll be back in Antarctica later this year via the Falkland islands and South Georgia, another experience of a lifetime.
You should all take such a nature trip to open your eyes to the importance and the urgency of preserving and protecting wildlife, including the Pueo owl, a Hawaiian Amakua, and preserving our prime AG land before it is all lost forever, buried under millions of tons of concrete and asphalt.
