Vol VI No. 622 Part 1c - Hawaiian Issues

I agree with you both. Recently, I received this question on my Facebook: 

"Aloha Mililani. I wanted To ask you a question about this new classification from the federal government which is the latest effort to push the tribal status on Hawaii nei. Is this the same as the Native American tribal label of "a domestic dependent nation"? Which would change the tax status of native depending on the definition of reservation? Or do you feel that the correct direction would be towards re-establishing the independent state which was a Monarchy, recreating a treaty with the US government?"

My Response was:

"A good question.

#1. The current approach being used under the DOI Hawaii Rule is not under the US policy for federal recognition of tribal status at all. If you review the Frequently Asked Questions from Interior you will see that the new Hawaiian Nation will not have any of the powers & authorities tat federally recognize Indian tribes currently enjoy. The new Hawaiian Nation has no land (other than Kahoolawe Island), it has no jurisdictional authority (Zoning, taxation etc.) and it has no right to go into US District Court for judicial review of its claims against the US or Hawaii stemming from the Overthrow. In addition, the new Hawaiian Nation has no ability to negotiate Treaties or implement the many historic Treaties entered into by the Kingdom, because State & Federal "Sovereign Immunity" is preserved. Hence, it is not a "Domestic Dependent Nation" under US Indian policy. It is a paper nation & has little power and no resources etc. I would say it is a domestic dependent nation of lesser status than indian tribes that are federal recognized and the Alaska Corporations. 

#2. The term "reservation" is not in the DOI Rule. 
DHHL remains the same, a State Agency implementing the US & State obligations under the DHHL Act of 1920 as amended. 
The 5(f) Ceded land Trust under the State remains the same, a State public Trust for the public and "native Hawaiians" with OHA getting 20% (allegedly) of the revenues but no land allocation.
Federal uses of ceded lands remain untouched. 

#3. I do not see how anyone could re-establish an independent Monarchy and re-create a Treaty with the US. If the US does not recognize existing Treaties with the Kingdom, how will you get the Congress & President to recognize the new Nations Treaty? Under the US System, the President negotiates & signs Treaties and the US Senate ratifies them. Obama chose not to do this, but instead to support a DOI Agency rule that the Congress did not initiate or authorize. I believe that when challenged, the process will be overturned by the Supreme Court for these reasons. 

If you assess our current situation, there are several "independent Hawaiian Nations" and a few "Kingdoms". Keanu Sai is a good example. 
He recently announced he had transformed himself into the King of his Kingdom. He has an Attorney General flying around with him talking about "independence", but in reality he has no independent Nation, no independent citizenry and no independent land base. It is all waha

When it came down to the US, Sai got $25,000.00 from OHA (A State Agency)  to write a letter asking US Secretary of State John Kerry "If the Kingdom still exists?" Obviously, King Said did not know if his Kingdom was really in existence so he had to ask Kerry! If Kerry said YES, Sai would have claimed that the US had 'recognize' his independent Kingdom. OHA then informed Kerry that the letter was not approved by the State OHA Trustees & recommended Kerry ignore they CEO's letter prepared by SaiThat's what happened, Sai & Crabbe never got any response from Kerry. So much for Sai & his Independent Kingdom. 

There was no way that Kerry would ever have said "YES, the Kingdom still exists" This was an impossibility given the fact that in 1993 the Congress passed a law admitting that the US had overthrown the Kingdom. This law was signed by the US President. There was no way the US Secretary of State would ever come forward saying that the Kingdom existed after the US Congressional admission that the Kingdom was overthrown by the US and replaced by a State under the USA! However, it was an easy way to make $25,000.00 off of our OHA Trust. 

Wala'au-ing about 'Independence' is not creating a nation and it is not negotiating a binding Treaty with the US. We are all entitled to have our own interpretations of history, but that does to make them a reality or plausible.

The US Doi Rule is a ruse & colonial effort to continue to disenfranchise Hawaiians and deny us our right to Self Determination. Read the UN Declaration on the Rights of Indigenous Peoples. Compare it to the new Hawaiian Nations powers, land, resource & territorial rights & authorities and its clear to see, the DOI Danner nation is not a nation similar to other Indian nations.

I suspect Mililani has had a lot of communication with SD Native Americans on this problem in her role as UN Diplomat on the rights of indigenous people. Perhaps she can share her own mana`o about this travesty of justice for native people in SD.

How many native Hawaiians are willing to contribute funding for more and more lawsuits against the City of Honolulu and state of Hawaii until justice is served? 

Attorney John Carroll has 23 part Hawaiian children and grandchildren and is doing his best to protect their and your future. At age 87, he still takes hula lessons! He told me that when he first moved here, he dated one of the Kawananakoa's.

I have not found anything online to discredit the next articles that describe how crooked and corrupt the US Government has become since the turn of the century, and our city and state government are just as corrupt under Democrat monopoly control.

Many of our Hawaiian people are enamored with the word "Nation" that they mistakenly perceive that 
the US is recognizing the "Hawaiian Nation" as being recognized as a equal Nation among Nations in the word Nation but not so.

The truth of the matter is that all American Indian Nations as we can see are in fact 3rd class U.S. citizens in poverty and short life expectancy  which is furthest from the real meaning of being treated as a equal "Nation: in reality.

The U.S HAS NEVER AND WILL NEVER  RECOGNIZE ANY INDIGENOUS NATION AS EQUAL TO ITSELF.

 Over  500 American Indian Tribal Nations  are currently under the oppressive thumb of the U.S. Department of the Interior AS WE CAN SEE.

THIS SHOULD NOT AND MUST NOT BE OUR PATH FOR RECOGNITION AS A "HAWAIIAN NATION:"

Our purpose and need is to educate our Hawaiian people  of the horrible history and path of native American Indian tribes being subjugated by this so call US Interior Department Nation to Nation subjugation and a poor trade off for the indigenous peoples who have never prospered in well being with this false path of tears, lie ,and deceptions that are the tragic experience of our Native American brother's and sisters.
