why is DLNR involved in "private" land issues. they're authority is limited to "public" lands. Go back to the basics!
King K3 separated Private lands from govt lands to prevent foreign conquest or takings. The answer to your challenge is not found in The Hawaii State Constitution, HAR or HRS, it's found in the allodio titles that designate these lands as "Private" in perpetuity.
Govt doesn't give permission for any activity on these lands, the land OWNER does! Currently what is giving DLNR power & authority over these lands & issues is our ignorance to the real Laws, principles & contracts which rule these lands. So stop & go back tk the allodio title!
Campbell was not the land OWNER. Campbell bought from Levi Haalalea who had a life time interest which ended if he remarried or death, which ever comes first.
Levi remarried which means his contracts with the cambells came to completion when he said "I do" to Amoe. See. Wailuku Sugar Co. Vs. WC Parkes administrator of the C KANAINA probate. Supreme Ct. Rules that contracts end w life time interests.
Levi left Ewa to his new wife, Queen Kalama & C KANAINA. He got 1 of 3 right.
If the lands belong in perpetuity to the awarded and the lands inure to the lineal descendents but there are none; then the lands go to the parents then siblings which there are two.
Bottom line, the permission to build or develop rests with the lineal Heirs of the awardee's siblings which I know personally & will be revealed soon.
Stop giving these monkeys power that they don't have!

There's a Pueo still hangin' on for dear life at UHWO-
Of the 500 acres the university received for free to develop a campus- the university only needed some 200-acres to fully develop the campus- and as a result, UH has some 300-acres as excess land to "play with."
Instead of using that 300-acres of excess land for higher education- such as an outdoor in-situ laboratory in which biology students could monitor and study the Pueo and other endangered species- right on campus- a priceless opportunity - and would cost nothing - however, in contrast, the UH BOR did the unthinkable with that property.....
----- Instead of the UH Board of Regents sticking with the business of pursuing higher education for their properties - they rather chose to get into the real estate business and has since moved to liquidate the 300-acre parcel currently utilized by the Pueo and turn such acreage into housing tracts and commercial ventures for profit- by leasing land dedicated for and meant for higher learning- into real estate enterprises.
All at the expense of the Pueo- UH BOR to this day, still claims no Pueo are on their campus nor have any been documented- a complete denial.....what do you see here:

Attached is another water study when I worked on getting an Ewa karst water
study RESO passed by the City Council in 2012. They massively killed it, would not
even hear very weak "watered down" version in final reading. It was like Rail-
unbelievable !
Also- EPA critical of Navy studies at Red Hill. Same problem. Navy doesn't
want to acknowledge the realities of water flow in Karst - limestone reef landscapes.
A UH Water study done in 2009 for Oahu states that a coral quarry site with high
volume karst waterflows is the absolutely WORST possible place for a waste dump.

On the high end are the coral gravels and reef limestones. These coral reef remnants have the
highest hydraulic conductivities of any formation in Hawaii with estimated values as high as
30,000 ft/d based on tidal response analysis (Oki et., 1996).

as high as 30,000 ft/d based on tidal response analysis. It means decades of continuous on
going ocean pollution. Just piling dirt over it only hides the problem.
I will send out a draft soon with my comments and criticisms if you would like to
use any. I am doing as much research as possible. Have contacted EPA Region 9,
State, etc. The Kapolei board needs to take a stand on this as understanding the
water flow under the karst into the ocean is critical to the future of West Oahu.

Ocean fisheries being killed off. Potential life threatening conditions for beach

DLNR can order DR Horton & State UH System at UHWO amend their EIS- and undergo a Supplemental EIS- which could yield a Habitat Conservation Plan- and placed in the Oahu General Plan (OGP).Ho'opili and UHWO should forfeit at least 500 acres for the HCP- for cheating the Pueo.
Instead of me there- you really need DLNR there at your meeting to field Q and A- did they DLNR askDr Horton yet to get permission to look for Pueo at Ho'opili etc.....access to property for the Islandwide Pueo Survey... they at DLNR won't answer me etc.
Why doesn't your Board stand up against UHWO's crappy plan to develop over 300-acres of prime Pueo habitat- your Board has remained silent.....that is a major problem.

I have nothing to add tonight for your meeting WITHOUT the players there to answer questions- so no need for me to be there -- get DLNR there- please execute resolve to get consensus from your Board to get PBR/UHWO/UH BOR/DLNR/RANA/HOOPILI there first- ---down the road- to discuss this Pueo matter- and Hoary Bat- mahalo- that is my preference.

UH West Oahu says "No Pueo's On Campus"
Basically, UH West Oahu seems happy to bury any traces of Pueo - their mascot-
in order to get on with large scale land development. "No Pueo Here" says UH
Honolulu Star-Advertiser 22 Aug 2016 "Federal and state officials say they are moving forward
with plans to survey and study the pueo as residents raise concerns about impacts of
development in West Oahu on the bird’s habitat." but so far there is almost zero evidence
of this happening in Ewa, West Oahu.
The State Senate passed a resolution to Save The Pueo in 2017 but the State House with area
Rep Ty Cullen supporting killing the House version while also at the hearing getting a promise
from DLNR would it would work with local Hawaiian cultural practitioner Mike Lee, which has
never happened.
Cullen and his Pueo death committee has never responded as to why he wants the Pueo
killed off in West Oahu and couldn't pass the simple reso like the Senate did. After all, it
DLNR's Siddiqi said. “It’s (pueo survey) something we’ve been thinking about for a while.”
Obviously they are still "thinking about it." Even though money was scrounged from mitigation
for Hawaii windfarms killing huge amounts of birds and bats, the UH Manoa has just
spent the money on a nice Pueo website that keeps promising they "might" actually do
thing other than just think about it.
Michael Lee, a Native Hawaiian cultural practitioner, suggested a conservation habitat plan that
would protect the pueo’s habitat in certain areas on the Ewa plain.
“Pueo is very much important to us,” Lee said. “Still yet it’s very powerful in our family.”
Evelyn souza, chairwoman of the Makakilo/ Kapolei/Honokai Hale Neighborhood Board, agreed.
“It never occurred to me how important the pueo is … because it was never the focal point.
And I’m kind of bewildered. If this is an … endangered, protected bird, why have we not in
place already those mechanisms to preserve it, to protect it, protect its habitat? But better
late than never.”
It's looking a lot like maybe "never" or at least until the Pueo is fully dead and buried by
DLNR and UH bureaucrats interested only in their paychecks.
State Sen. Mike Gabbard (D, Kapolei-Makakilo) said last week’s meeting served as a starting
point for more work and conversations about the pueo’s future in the area.
“People who live out here care about the issue,” said Gabbard, chairman of the Senate Water,
Land and Agriculture Committee. “It’s key to get the results of these studies in order to make
decisions, as policies are based on the science.”
Admin. UH West and all campuses for that matter have in their mission statements
the emphasis on "Hawaiian Culture" and the "indigenous population."
However the usual UH Administration types - over paid and in it for the next pay raise,
just use these "mission statements" as the usual BS fluff, as does DLNR that it
is "saving" the Pueo. Actually nest to NOTHING is happening in Ewa West Oahu.
