For Kauai folks who do not understand the power of the US FWS Threatened and Endangered Species Act, here is an email sent by Hawaii to the US FWS claiming there was a stop work at Coco Palms. Ask yourself why an Injunction was not filed. From: Kaiakapu, Thomas J

GOOD DAY FOR THE KOLOA DUCKS AT COCO PALMS!

We have been filing legal documents with all of the wildlife agencies in Kauai, Oahu and the mainland that have authority over the proposed Coco Palms development.. We have demanded that the Endangered Species Act be followed by the Coco Palms developers. Last Friday evening the developers entered the property with heavy equipment of which could have disturbed the nesting Koloa Ducks and Moorhens which would be a potential violation of federal Law.
Today Thomas Kaiakapu who is the Kauai Wildlife Manager for the DLNR Div of Forestry and Wildlife just told me via email that he met with the Coco Palms architect Mr. Agor and recommended to stop all work on the property. Mr. Agor agreed to do so!
This is the first step to make sure that the our wildlife laws are followed because the proposed development happen to be in a wetland that is habitat for several endangered bird species!
On Friday I filed a report with pictures showing where the birds are on the property and how the construction activity Friday was a violation of federal law. All of the people involved in this ground disturbing process were sent the complaint documents along with each government agency including the County Of Kauai Attorney.
Lets now hope that the rights of the endangered species at the Coco Palms will be protected along with the people there that are trying to restore their native habitat!
Noa also supplied me with the old survey map that clearly shows that the entire Coco Palms is a historical wetland that had extensive fish ponds and wetland farming! This is the original wetland habitat we wish to restore for the protection of the Critically Endangered birds that live there!

Noelani Josselin On my way to work yesterday, Friday 3/19/2018 at about 11:50 a.m. I passed the south end of the coco palms property using Kuamoo Rd. to avoid traffic and noted that there were much activity going on in there. From what i could see there was a work crew of 3-4 men wearing yellow/ orange safety colored shirts and heavy equipment, dump trucks and roll offs . Looked like "grubbing"

Ruthann Caudill These ducks are protected under the US FWS Threatened and Endangered Species Act. Coco Palms does not have the paperwork for what they are doing.
The Government should have stopped Coco Palms Hui, LLC, so the Emergency Injunction will start a Legal Process which will include many Law Suits.
