This December 10, 2017 article from The Garden Island newspaper reported —
“Coco Palms Hui exists under the business umbrella of the Greene Waters Group, a Honolulu real estate developer.”
“Like most companies in its business, Greene Waters Group has an inconsistent record of delivering on its development promises. Its website, for example, identifies an Oahu Hotel called the Endless Summer Resort as opening this year. The property, according to the website, is to include a gigantic, artificial surf-generating pool.”
“But as this is written, the Endless Summer Resort still lacks a site, much less evidence of construction and no word on an opening date. Coco Palms Hui said its plans for the surfing hotel are on hold indefinitely, until it finished construction on and reopens Coco Palms.”
“The firm said its financing and construction plans are on target. Kauai County officials said Coco Palms currently has 24 pending building permit applications on file.”
“They have successfully completed the demolition process and disposal of hazardous materials, and they are now in the process of obtaining building permits. These permits do require the developer to hit certain benchmarks to ensure that the project moves forward in a timely manner.”
“Although Coco Palms’ building permits are still under review, the county’s Engineering Division has concluded that the entire Coco Palms site is within the floodplain that could be inundated during a hurricane or tsunami. Although Coco Palms is permitted to rebuild on its original footprint, the resort must still comply with flood abatement standards in the current County Code.”
“Those standards are more stringent than they were in 1992. The code would require that any spaces at ground level — which were in use as hotel rooms in the original resort, could not house guest accommodations or would have to be completely flood-proofed.”
“It remains unclear whether Coco Palms Hui has full financing in place to proceed with construction.”
“The final mix of investors will be a combination of individual and corporate entities,” Greene said. “The current project cost is $140 million.”
“Asked to identify the investors, Greene said, “As a matter of standard practice, we don’t release investor information.”
“Information available in public records, however, suggests that Coco Palms Hui has struggled so far to attract investor support. In 2014, for example, Coco Palms Hui filed with the U.S. Securities and Exchange Commission to offer eligibility for U.S. visas in exchange for investment commitments of at least $500,000 by non-U.S. citizens. The program was intended to produce $28 million in investor commitments, according to the SEC filing, although only $1 million had actually been raised.”
“The filing also noted that BPG Hawaii LLC, another entity owned by Greene and Chad Waters, the other principal in Coco Palms Hui, intended to collect $800,000 in sales commissions and finders fees from the $28 million offering. How much the visa-for-cash offer produced is not known.”
“To raise the capital necessary to proceed with demolition, Coco Palms Hui obtained a loan from Utah-based Private Capital Group, LLC., which specializes in investments in distressed properties. The company’s website says it is interested in “foreclosed or distressed commercial and residential developments that may require improvements, construction or rehabilitation.”
“Coco Palms Hui declined to disclose the terms of its financing from PCG, but federal court records indicate that the firm has been involved — in some capacity — in 24 cases in U.S. Bankruptcy Court and eight other federal court cases.”
“This raises into question PCG’s due diligence in assessing the financial positions of those to whom it makes loans.”

This Coco Palms Loan Company, LLC application states —
“The proposal identifies the new commercial enterprise (“NCE”) of the project as Lexden Coco Palms Loan Company, LLC, which was formed in the State of Delaware on January 31, 2014. The project is located at 4-947 Kuhio Highway, Kapaa, on the island of Kauai in the State of Hawaii. 172 immigrant investors will subscribe to the NCE as limited partners in exchange for capital contributions of $500,000 each and an aggregate of $86 million. The NCE will loan the $86 million of EB-5 capital to a third-party entity, Coco Palms Resort. The EB-5 capital loan proceeds will be used to acquire and re-launch The Coco Palm Resort as the Coco Palms by Hyatt in Kauai.”

Based on the definition of the Federal Regulation at 8 CFR 204.6(i), the Island of Hawaii and Island of Kauai are rural areas and the whole islands are qualified for $500,000 investment under the EB-5 program. The Island of Oahu is a metropolitan area with certain areas on the island designated as targeted employment areas (see Honolulu TEA) for the map and data sheet for the TEA on Oahu. The Island of Maui, Molokai, and Lanai are under the Kahului-Wailuku-Lahaina metropolitan statistical area (MSA), TEAs on these islands are listed in the Excel file under Maui TEA tab.

Miki Miller So therefore, Chad Waters and Tyler Greene have been involved in this since at least 2013, not just the ‘new owners’ as of 2016.

What do you think the propability is that they were involved with the proposed Coco Palms development since 2013 without knowing that the December 2014 Lexden Coco Palms application stated that they were planning to solicit up to $86 million in EB-5 Visa loans.

Miki Miller The status of Kaua`i as rural, qualifies the EB-5 loan investors at $500,000 instead of having to loan the developers $1 million to qualify in non-rural districts.

This rural designation also allows Hawaii Regional Centers to use jobs numbers that th
ey are creating in Honolulu to be added to their employment projections for the Coco Palms Hyatt.

By using an EB-5 Regional Center, the developer does not have to actually create 10 full time/permanat jobs per EB-5 Loan in order for the wealthy investors and thier familiy members to qualify for their Green Card and subsequent U.S. Citizenship.

4. If any man wish to obtain an allodial title to the land which he has himself cultivated, he shall have the right to petition the Minister of the Interior, in writing, who, in connection with the Minister of Finance, may determine on the terms of sale, which being complied with, an allodial title to said land shall be given under the great seal of the Kingdom, as prescribed in Act 2, part 1, chap. 7, art. 2; after which the owner shall be no longer liable to ...the government labor tax, nor to the labor tax of the Konohiki. That burden shall be removed, but the highway tax and other taxes for special emergencies shall remain. The pay for said lands shall be divided equally between the government and the Konohiki.

NATIONAL RELIGION
Section VI. The religion of our Lord and Saviour Jesus Christ shall continue to be the established national religion of the Hawaiian Islands. The laws of Kamehameha III., orally proclaimed, abolishing all idol worship and ancient heathenish customs are hereby continued in force, and said worship and customs are forbidden to be practiced in this kingdom upon the pains and penalties to be prescribed in the criminal code.
Section VII. Although the Protestant re...ligion is the religion of the government as heretofore proclaimed, nothing in the last preceding section contained shall be construed as requiring any particular form of worship, neither is anything therein contained to be construed as connecting the ecclesiastical with the body politic. All men residing in this kingdom shall be allowed freely to worship the God of the Christian Bible, according to the dictates of their own consciences, and this sacred privilege shall never be infringed upon. Any disturbance of religious assemblies or hindrance of the free and unconstrained worship of God, unless such worship be connected with indecent or improper conduct, shall be considered a misdemeanor, and punished as in and by the criminal code prescribed.
Section VIII. It shall not be lawful to violate the Christian Sabbath by the transactions of worldly business. The Sabbath shall be considered no day in law. Wilmont Kamaunu Kahaialii In honor of our kupuna who signed the Ku'e petition, members of our ohana signed our names on the ku'e petition last year, to continue the protest against the illegal and unlawful acquisition of the Hawaiian Islands under the guise of annexation to the United States. COINS AND CURRENCY.
Section I. If you want to know the voice of the opposition, this is it.
It's not the folks hired as token consultants or desperate for jobs as maids and janitors.
It's the transnational corporate developers we as Kanaka freedom fighters need to focus our attacks on.

Aloha & Good Morning Kauai! I appreciate this page and often scroll through to keep up to date on what is new and happening on the island that we all love. ...As the developer for the Coco Palms Resort, I would like to personally respond to this group and the one member that has posted erroneous information numerous times, 30+ and counting, on this page. It seems to be the same incorrect information over and over and over again. Based on the responses to these posts, very few people care about the EB5 financing program. Here is how just about every post starts “The Coco Palms Hyatt Resort developers solicited as much as $86 million in loans from wealthy Foreign Nationals using the EB-5 Golden Visa program”. For those of you that could care less about how Coco Palms may or may not be financed, please disregard this posting. However for those of you that would like to hear the truth, Coco Palms has neither solicited or raised $0.01 in EB5 funds. End of story...let’s move on to something else ok? We are all entitled to our opinions about Coco Palms or any other subject. Post away! However, I think we all agree if that we are posting something we are presenting as a fact, at least please try to make it factual. Regarding Coco Palms, if you want to know the facts, just ask.
