out of my hands and submitted anyways with the edits I did not approve-

TO DEPT of AG/DLNR/DOFAW/UH SYTEMS-  
I have located the ideal site-  
It's currently not in farming production-  
there are no mongoose, no feral cats and
no dogs around, BUT TEAMING
WITH VERMIN and such a location 
would be ideal to serve as a Pueo Preserve-

PROPOSED PUEO PRESERVE (ALSO USED BY BA...


The Pueo is there at this SITE sporadically-BUT MOSTLY
in June through September to nest- the Pueo traverses the 
Honouliuli Stream away from the farmers best it can- 
hence, the impetus for the NEW RESOLUTION as
THE SOLUTION to the extirpation of the Pueo from
its home on the Ewa Plain south of the H-1 Freeway.

COMMENTARY: 

With the Pueo being extirpated below (Makai) of the H-1 Freeway, 
the Pueo currently have relocated its traditional nesting activities 
above the H-1 Freeway to where I have followed it and thereby 
advanced the intent and calling for HR 152 / HCR 170 to be 
introduced via grateful actions of Reps Kong/Cabanilla -
and your support of the Resolution would be beneficial and 
of value.  

Without this RESOLUTION, no action by UH, DLNR- or any landowner
thereof be it use by military, private sector, City or State, or even USFWS---- 
none has sought to dedicate any refuge, preserve, sanctuary, park, or conservation 
wildlife quadrant whereby the Pueo is the sole beneficiary of the property and all 
actions in the territory of the preserve are designed for, cater to, and serve the 
direct needs of the Pueo-  such as the area contains no rat poison, no controlled 
burns, no nearby pesticide spraying, no ATV's or recreational uses, no dual farming 
uses, or tree harvesting uses, and features as is, no cats, dogs, or mongoose to harm
the ground nesters-  no such place exists on Oahu, but could, where I have illustrated
and the RESOLUTION directs.


TRUTH:

"Wherever you find the Barn Owl in open range away from human activity,
the Pueo is either there, was there, or will be there-  for both species of owls
share the same interests; ---and we have found such a location that satisfies 
a niche meeting all the ideal requisites to protect and dedicate to the Pueo that 
is in peril on the Ewa Plain of Oahu - and such a preserve to serve to act as 
reclamation, remediation, and mitigation due to the Pueo being extirpated where
it once thrived-  all on behalf of the Pueo- where also, the Hoary Bat still lives."

CONCLUSION:

It has been exhausted - the call to get government 
to follow environmental law, and for the University
of Hawaii to execute a Habitat Conservation Plan 
(HB1392/ HB1592 of 2019; HB2629 of 2018) for 
and on behalf of the Pueo purged from its habitat 
at UHWO/Ho`opili/DHHL/West Loch Blast Zone/
and Kalaeloa on the Ewa Plain- the effort to save its
habitat did not blossom....

But now-  we have State Representatives Sam Kong 
and Rida Cabanilla to thank for keeping the concept 
of a Pueo Preserve alive against all odds. 

How can anyone object to this proposal?  These Pueo
have their own genetic gene pool-  a diversity needed
to protect the species whereby more than one area to
sustain them needs to be established for successful 
breeding- the HONOULIULI PUEO ARE WORTHY OF 
PROTECTING- this would augment SENATOR 
MIKE GABBARD's BILL too- SB262-
a win-win.

ATTENTION -  PROJECT PUEO TAGGING @ LUALUALEI:

This is why you should support the pueo preserve in Honouliuli Ahupua'a-  
as described for/called for in HR150/HCR170-   it is not prone to fires!

To even think Lualualei/Nanakuli/Waianae areas are keen for pueo-  think again-  
these areas are prone to wildfires non-stop-  perpetual.  And, it's best to have 
not placed all of "one's eggs in one basket."   

HR150/HCR170 also has Cane Haul Roads throughout for Fire Department 
Firefighters to access if need be-  something no other "wildlife" preserve 
contemplated features as is........and if the pueo did not get torched in the 
Nanakuli /Waianae Fire(s)- they (PUEO) certainly lost a vast amount of prime 
foraging refuge acreage /grounds -   and hence, all the more reason to 
protect prime foraging areas/pueo habitat in the Honouliuli Ahupua'a
as is offered for your support per HR150/HCR172.

RE: A House Resolution was introduced this legislative session to provide a preserve-  a protected habitat for the pueo within the Honouliuli Ahupua'a.
 
Of interest to this approach utilizing the reso, is that unlike the previous attempts to garner a Habitat Conservation Plan via a bill whereby the legislative measures had pitted landowners against the pueo, and the powers that be gave the impression that they were unwilling to budge to even recognize the pueo in existence- this attempt however in contrast, is without friction, lacks competing interests, and the land end use for the pueo a natural fit as if it were meant to be all along right under our noses. 
 
This Resolution (HR152/HCR170) hones in on an area that is prime pueo habitat not being utilized for any human venture nor is the land dedicated or slated for development as we know it.
 
The area to be dedicated for the pueo preserve would also serve the bat and other creatures in peril that are without refuge-  without a voice, a win win for all under siege in the wilderness being swallowed up.  

(It can be deduced, that the pueo tagged in the Lualualei region by Project Pueo recently, are indeed in the Honouliuli Gulch and utilize this basin as a safe zone, a place of refuge, and the landmass considered prime/ideal foraging grounds- for where we have abundance of barn owls, rats and mice, we can for certain, by way of substantiated proven evidence, conclude the pueo frequent the same niche as the barn owls as they both have the same interests and seek out the same areas in which to proliferate- to a degree.)

The Resolution has its advantages too in that the proposed gulch area lacks the presence of mongoose- and also, is without feral cats or dogs roaming the landscape that prey on the ground nesting pueo. And, thus far, no cane toads in abundance that are poisonous to the pueo if the pueo eat them-  all factors that cause the pueo harm one way or another. In fact, the gulch is teaming with vermin - and more importantly, vermin unexposed to the rat bait poison/anti-blood coagulant used to kill rats -  and rats are a key foodstuff luxury to sustain the pueo to augment its diet of insects-   point being, this area has not been subjected to the dispensing of the rat bait pellets known to kill raptors- of which the pueo is.

In addition, the proposed protected habitat is not prone to military training exercises, fire-department controlled burn exercises-   and,  the various tree lined plateaus within also contain open fields of raw grasses that the pueo uses to forage  -  these land features have its grade separations and natural culverts and gullies to buffer the preserve from the onslaught of nearby pesticides spewed by the experimental farming enterprises that surround the landmass up above to the east and west of the gulch floor/basin bottom.
 
The text to the title of the reso is as follows:

REQUESTING THE DEPARTMENT OF AGRICULTURE, DEPARTMENT OF LAND AND NATURAL RESOURCES, UNIVERSITY OF HAWAII, AND ANY OTHER RELEVANT STATE AGENCY TO DEVELOP A MAP THAT DEFINES THE MOST SUITABLE AREA WITHIN THE HONOULIULI GULCH FOR A DEDICATED PUEO PRESERVE AND DETERMINE THE REQUIREMENTS TO ESTABLISH THE PRESERVE.

is there- just too elusive at this time to capture it on camera-  but has been seen-  albeit, the pueo are
on the move between November through April months and come to settle down in June through October
to court, mate, and raise a brood per our empirical analysis and extensive research /observations of the 
pueo at UHWO/Ho'opili properties for many years.

My name is Tom Berg, a former Grantee to
HI-03-0047-02 Light Rail Project (2011-2013)-

I request your office examine the documentation 
whereby the City and County of Honolulu had
presented a falsified NCRS CPA 106 Form to the 
FTA - such claim of fraud can be proven by watching 
the exhibits/evidence presented in the youtube 
video made to expose the breach of FFGA terms
and conditions - link to youtube pasted below.


WHEREAS, 1. Federal Law protects productive farmland; and

WHEREAS, 2. Honolulu fabricated /presented a fraudulent 
                        representation of the rail route's path through
                        farmland to the Feds; and

WHEREAS, 3. Per State of Hawaii Records in Historical 
                        Archives, the rail route traverses through
                        farmland that was recorded as the most 
                        productive farmland in the entire State of 
                        Hawaii, which translates into the most 
                        productive farmland in the entire USA; and

WHEREAS, 4. President Obama and FTA/USDOT covered
                        up for the breach whereby the FTA accepted 
                        the property of the rail route to be traversing
                        through unproductive farmland (a patently false 
                        claim), and the route would displace no farms, 
                        no farmers, nor reduce crop production on any 
                        degree; now therefore

BE IT RESOLVED, you are requested to watch the evidentiary 
                              material fact so presented in the youtube that 
                              details and explains with exhibits and names, 
                              targeting those that misrepresented and 
                              mischaracterized the true status and features
                              of the farmland destroyed to make way for the rail
                              WITHOUT ANY MITIGATION- which is REQUIRED 
                              BY FEDERAL LAW.

THE BREACH LEVIED -
PER THE FEDERAL LAW THAT 
MANDATES THAT ANY LOSS 
OF PRODUCTIVE FARMLAND IS 
TO BE MITIGATED PRIOR TO THE 
EXECUTION OF THE FFGA.

The project and the contract brokered as portrayed by 
Honolulu was an act to deceive, mislead, and swindle 
the FEDERAL government- AN ACT TO DEFRAUD.

Dr. Kioni Dudley tried and tried to get this breach to the FTA's
attention- immediately---

But the Obama Administration hid the data- and covered up
for the fraud.  With President Trump now at the helm, we 
hope justice and fairness, and the rule of law will be restored.
