"The Office of Hawaiian Affairs filed a lawsuit on Tuesday against the state and the University of Hawai'i for what the group calls the "longstanding and well-documented mismanagement of Mauna Kea."
OHA is asking the court to order the state to fulfill its trust obligations and to terminate UH's general lease for the mountain due to breach of lease terms.
"The state and UH have failed to properly malama Mauna Kea and have demonstrated their inability to ensure that the environmental and cultural significance of the mountain is recognized and protected, " said OHA Trustee Dan Ahuna, the chair of OHA's Ad Hoc Committee on Mauna Kea. "This is not about any one telescope. This lawsuit is about addressing the state's failure to manage the entire mountain for nearly half a century."
According to OHA, there have been four state audits. The initial audit in 1998 concluded that "little was done" to protect the natural resources on Mauna Kea since the first telescope was constructed in 1968. The three follow-up state audits revealed that while some progress has been made, more needed to be done.
In 2015, Gov. David Ige said that the state has "not done right by" and "failed" the mountain. Click here to read Gov. Ige's full statement on Mauna Kea. UH President David Lassner supported the governor's plan for Mauna Kea.

HPD arrested a 19-year-old man accused of painting over the face and body of a statue of Prince Kuhio in Waikiki. Officers arrested Andrew Chalaire just before midnight Tuesday on Kalakaua Avenue near Ohua Street. Someone walking by noticed the vandalism and posted it on social media.

Throwback Thursday: The question above was asked of me in several forms by various Facebook users in regards to last weeks TBT. In fact, this question has continued to reappear in my inbox ever since I began posting videos of HKT and the many other brilliant Kānaka Maoli leaders. This weeks clip simply seeks to answer and demonstrate what I feel is an appropriate response to what HKT and so many other Kānaka have been trying to say regarding foreigners in Hawaiʻi. To sum it up, all I'm saying is, #KnowYourHistory #KnowYourRole #SpreadTheKnowledge and #KeepTheConversationGoing
P.S, LaRene Despain is actually reeeeeally cool. I met her by chance last year and got to thank her for all the ways in which she supported HKT during all the craziness at the University. Definitely a good-hearted woman and is a prime example of #HowToHaole

The Kahea is out for this important meeting on Oahu Tuesday, 10-3p.m. Where the Hawaii Environmental Policy Act is at risk. The agenda includes an attempt by Omidyar funded Ulupono and Group 70 to change the Hawaii Administration Rules (HAR) as they pertain to the Hawaii Environmental Policy Act (HEPA).

This can impact efforts to curtail any development project as it minimizes the response effort to multiple queries of concern from concerned public and groups.
There is no question that Hawaii Dairy Farms was informed their Final Environment Impact Statement (FEIS) was deficient. Rather than comply with HEPA in conducting their Environment Impact Statement (EIS), they are now actively trying to change the very regulations that they failed to comply with. specifically, they want to eliminate the developer's requirement to answer each public comment filed in response to a draft EIS. The Environmental Council (EC) Draft Version .3 adopts the Ulupono/Group 70 recommendation that a developer be allowed to batch the comments and frame one response to the batch without needing to address/respond to each comment which is now the law. Today's Hawai'i Office of Quality Control's Environmental Council meeting, in Honolulu, for the the proposed draft rule changes/updates to Hawai'i Administrative Rules - is only for a discussion document and no formal decision making is taking place on it.
Typically, these kinds of rules are drafted and only released for public comment officially - once.
What's happening here is the council is making all of it's working discussion documents public.
it's soliciting feedback on those.
The comments come in and are incorporated into a new draft for discussion purposes
and there is about a month or so to comment.
There is anticipated to be one more version of the draft rule changes (v0.4) that will be released and will be amended based on all the comments received during this round of feedback, then, if the council chooses to, it will vote out v0.4 as the version for the official public comment period.
During the official comment period, there will be at least one public hearing in each county.
People have a few weeks to comment on this working draft version. (11/22/17)

​"Joshua Wisch, special assistant to state Attorney General Douglas Chin, said that before TMT International Observatory LLC can begin construction, it first needs a “notice to proceed” from the state.
The lessee, the University of Hawaii at Hilo, is now working on a plan to implement the 43 conditions imposed by the Land Board on the construction permit, spokesman Dan Meisenzahl said.
A potential stumbling block is the project’s 6-acre sublease, which was invalidated by Hawaii island Circuit Judge Greg Nakamura in January. Nakamura ruled that the board violated the constitutional rights of E. Kalani Flores of Hilo by denying his request to a contested case hearing in 2014 prior to allowing the university to issue the 6-acre sublease to TMT.
The state, which opposed the ruling, has appealed the case to the state Supreme Court. Briefings have been filed in the case, and the next move — whether it’s scheduling oral arguments, issuing a ruling or waiting to combine the case with the TMT appeal — is up to the court.
David Kauila Kopper, the Native Hawaiian Legal Corp. attorney who represents Flores, said he believes it would be improper for TMT to begin construction without a valid sublease.
Looming over these events is TMT’s self-­imposed deadline. The board of the California nonprofit, with partners in India, Canada, Japan and China, continues to insist on starting construction in April, whether it’s on Hawaii’s tallest mountain or an alternative peak on La Palma in the Canary Islands."
