I am praying all day - it just has to be Trump, it just has to be. How on earth could any human educated, able to read and write, cast a vote for the devil- why, in the name God, why would any person think Hilary is not a racist- for she is the main reason we are divided and that is her goal, to divide us- "Unite us Lord, let us be color blind and make certain all lives matter and stop the hate spewed by the Hillary people trying to take down America and fuel racial tension with lies. Kai Markell will present on the Office of Hawaiian Affairs’s advocacy role in protecting and perpetuating Native Hawaiian culture, the environment, and historic and cultural resources, with a particular emphasis on OHA’s efforts to protect the native pueo in the ‘Ewa region.

Kai Markell is a Native Hawaiian Rights attorney who has worked in the area of historic and cultural preservation and perpetuation for the past twenty-two years. Former Director of the Burial Sites Program at the Department of Natural Resources, he next worked as Director of Native Rights, Land and Culture at the Office of Hawaiian Affairs and is now a Compliance Enforcement Manager at OHA. He has been qualified as an expert in Native Hawaiian burial practices and burial protection, as well as qualified as an expert in cultural impacts, in the 1st, 2nd, 3rd and 5th Circuits. He is married with two sons.

E kala mai! Forgive me for on Friday Nov. 4 I sent what I listed as my last email concerning the 2016 Presidential Election. I lied!

But I did so, of course "believing" that at least the "FBI" was the last "Bastion of Truth" within the sanity of the United States of America. I was overwhelmed with FBI Director Comey's stand at least for "fair play or wait a minute" in that finally there was a "light of truth" within the dark "Tunnel of Fraud" since Mr. Obama took over the United States of America, Incorporated. I was awfully wrong, in fact if Hillary Clinton succeeds Obama, the Free America as reknown in the World may end up enslaved or dead much like that of the Middle East Nation are now!

I am not saying that Mr. Obama is the only USA President to cultivate Fraud. In fact, Fraud has always been one the "cash-crops" of the United States of America, "In or Un" Corporated. I also believe that of Mr. Obama's "Democracy" matches most of the media "Christianity" of today, and that of the true Word of God Almighty is their main target.     

As I mentioned last on Nov. 4 Friday a dozen of "Trump-Ums" gather for sign waving on Punchbowl and Beretania Street on the east end of the "Fake Estate" . By 4:00 pm about (75) members of a Christian Fellowship also gathered in the front of the "Fake Estate". I ask them what was the occasion of their gathering and iot seems that they just instructed to show. As I stood with a 4 x 8 foot tri-colored Trump/Pence sign, some of them asked, "why was I standing alone there"? I replied I was standing for Truth just as Iesu Kristo stood alone for Truth. I ask if they wanted to hold smaller Trump/Pence signs and they refused saying " we stand for Iseu Kristo and not Politics". I told them that Iesu Kristo was also Politician that was appointed by God Almighty to save God's most scared Creation Man, and that Man had turned away from God's Messenger much like that now of the two politicians vying for President of the USA. Two agreed with me but most horizontally shook their heads indicating "NO" and walk away from just the masses did to Iesu Kristo. 

Every moment of our life we have the opportunity to share or stand for Truth. But in today's media world Truth is disguised in many forms.  

I had mentioned that it was not Pontius Pilate or the Religious Power of the time that crucified Iesu Kristo but it was that of the consent of the people who turned their backs on God's Messenger of Truth, just as some people will again turn their backs to Truth on November 08, 2016 Presidential General Election.  

Mark Twain said; "If you tell the Truth you don't have to remember anything". Pilate while speaking to Iesu Kristo looked Truth in the eye and did not recognize it? No wonder it is so difficult for us?      

Tomorrow on November 08  once again Truth will be tested. I have attached an article by Scott Lively titled "Never Trump Equals Clinton Forever" that shares an insight that is quite common in any "Voting Society", "if I No Vote at least I never contribute or influence the disaster"? Once again like of History, Creation will be afforded the opportunity to recognize Truth. I believe the Clinton's and Obama are just Chapters in the Book of Fraud and what is destined for Creation is even beyond their interpretation or comprehension. 

I believe the "Middle East can never be part of the United States of America but the United States of America will become the Middle East". The choice before you November 08, 2016 is based upon who of the two leading candidates do you believe right at this moment is best qualified to secure the later of my belief?

Albeit you have the TV stations and StarAdvertiser covering up for your noncompliance, thank goodness we have the Ombudsman in play to call you out when warranted.

The Ombudsman contacted me and asked me if my request was honored-  I apprised the Ombudsman, you did not.

I shall ask again: Please place on the HART agenda, for public testimony- the said subject matter of PUEO; NEW CONDITION to Environmental Impact Statement/Call for Supplemental EIS.
Word it as you deem fit.

I contacted the Ombudsman weeks ago regarding HART refusing to place on any agenda, the matter of the law 
that states that any "New Condition" after the Environmental Impact Statement (EIS) was recorded, must be investigated
when proof or evidence of a NEW CONDITION is brought forward that reflects inhabitation and or utilization by a endangered plant
or animal on the property that was not originally processed for mitigation.  

I have countless evidence recorded on camera of the Pueo (endangered Hawaiian Owl on Oahu)
utilizing and counting on for survival - the property owned by HART.

I have repeatedly requested the Rule of Law be followed and HART be in compliance.

HART has refused to investigate, refused to respond, and refused to place in any fashion, the said 
such subject on any agenda for action and recourse.

This is in violation of our EIS protocols.

I, Tom Berg, in this electronic communication hereby
advance for investigation the complaint against HART
for abrogating it responsibilities and duties in direct violation 
and in noncompliance to the Rule of Law so defined in our 
Hawaii State Constitution that endangered species are to be protected by
the State and its assigned agent/DLNR in this case.

The presence of Pueo at the East Kapolei Rail Transit Station area has been documented for over a year- with a September 27, 2015, recording and again just a few weeks ago proving, this is no
flyover, but a direct inhabitation by this endangered species.

The Pueo nests are located off/away from HART's property (of the right of way corridor for rail operations) by 50 yards
but the Transit Oriented Development (TOD) jurisdiction stretches out for a two-mile radius under the control of HART 
and the City and County of Honolulu.   The noise from rail is too, supposed to be factored in for endangered species off property to be effected/and or subjected to
rail operations.

In this two mile radius TOD, the Pueo are to be adversely affected. Federal subsidies for housing are being sought for this two-mile radius TOD.
The federal government requires mitigation of Migratory Species under the Migratory Species Act. Barn Owls qualify. And there are two Barn Owl nests
within the actual rail corridor right of way specifically.

*The Barn Owl has nests of which exist in this location due to the rail not being in operation/dormant- hence, at this time,  rail is generating/making zero noise and 
thus, not disturbing the Barn Owl nests and also, allowing the Pueo to use this property for their survival.

The noise, development of the station itself and its operations, has not been addressed as by law requires, since the Pueo, before the rail was built, 
historically and to this day, flew and fly over the rail transit station at East Kapolei to forage.  

Will the Pueo be able to fly over a rail transit station that when built out and in operation, will have transformed the entire
surrounding landscape into a busy bustling noisy hub with bus stop, elevators, parking feature and such?  HART has devised a
rail system that every four minutes or thereabouts is to race by (between 4am and 10pmdaily) a screeching and emanating 70 decibel noise level at-grade, 
but where the Pueo fly above the elevated guideway, the noise decibel level is to exceed 110 at two stories and higher.

HART failed to provide such answers and mitigation for the presence of Pueo-  HART, in the EIS, recorded a faulty, flawed, and corrupted analysis 
that claimed no Pueo are in the vicinity of the rail and its TOD schemes-   this is a lie.
