Aloha Attorney General Ms. Clare E. Connors,

My name is Tom Berg. I am a party to the cause of action that generated

your letter to State Representatives Bob McDermott and Rida Cabanilla,

dated February 26,2019.

This email is regarding your opinion that DLNR has not been presented

with evidence to substantiate protective measures be afforded to the

endangered Pueo at UH West Oahu and therefore as SEIS was

determined to be unwarranted.

In the Response Letter to you from Mike Lee- sent by email on May 10, 2019,

documentation to substantiate that indeed, a Pueo breeding and foraging ecology

exists on the property----such information as documented /evidence/proof - has not

been acknowledged as received by your office nor has any response to the evidence

itself been generated to date.

This act- to disrespect and ignore the significance of Mike Lee's proof DLNR

and UH Systems has acted in bad faith, is hopefully going to be corrected by

your investigation after seeing for yourself, how DLNR has willfully

mischaracterized the property. DLNR has claimed there is no habitat serving

the Pueo, when clearly, we have as a community, proven without a doubt, Pueo

inhabit the property.

The breeding ecology behavior is seen at the 10:28 minute

mark in link above. DLNR has not offered comment on the rebuttal

as provided my Mike Lee's Response Letter to the evidence contained

in the videos. The evidence counters DLNR's claim that no Pueo use

the property for anything other than as flyby territory. This claim by

DLNR is patently false.
