I just received this document from Senator Mike Gabbard -
answering the inquiry per Mike Lee's complaint with the Ombudsman:
Complaint #19-00747 (HA)
You were right from the get-go;
that no nesting activity is at all,
needed to trigger DLNR/DOFAW
to act accordingly (protect the pueo)
and adhere to the endangered species law-
Hence, the SEIS law as written into the FEIS for UHWO, states:
UHWO shall conduct an SEIS in the event a new condition overlooked
in the original FEIS has since become present on the property in order
to determine how the planned development will effect the new condition.
The pueo is the new condition now observed on the property. Law 101.
Please share this most important confirmation of your assessment
to all of those following this breach/act of non-compliance to the
endangered species law as masterminded by Suzanne Case, Chair
of DLNR. Case has willfully violated your civil rights and religious practices
as are afforded on a State level (Article 12, Section 7 of the Hawaii State Constitution),
as well as federal mandates that per the courts, are to provide you remedy.
If the Ombudsman does not rule in your favor- a petition to remove/impeach Governor Ige would be in order.
As it is he, Ige, per the FEIS, who as the accepting authority---is by law, required to order
the SEIS be executed when DLNR certified in 2017 that pueo are there.
Mahalo for your legal expertise- now confirmed on official
communication levied by the Legislative /Senate Majority Office Attorneys.
Albeit Senator Gabbard has not been a good steward to the pueo in his own legislative district,
we owe him a bit of thanks for being the only one who gave a damn to solicit this finding IN WRITING-
NO NEST IS AT ALL NEEDED-
Hence, UHWO therefore, in its fraudulent actions (claiming a pueo nest was
required to protect the pueo as depicted on its website) ---that to act, a nest must be present,
is 100% patently false- deceitful, and acting in bad faith- they all have, dirty hands.
And the UH Board of Regents, owners of the property, are in violation of the law and have done so,
with malice/intent to cause you great irrevocable harm by destroying the pueo and its habitat with
Administrative Bias.
