TALKING POINTS FOR HB1392 AND ITS PASSAGE

Under Federal, State, and City and County of Honolulu jurisdiction / domain, there is a condition, or lack thereof, whereby a dedicated landmass that is designed to sustain the endangered species Asio Flammeus Sandwichensis, referenced as the Hawaiian owl, and called by the people of the State of Hawaii, the pueo, for its proliferation on the Island of Oahu, whether it be a preserve, refuge, sanctuary, park, or conservation area.

Count I : INTERESTS OF PUEO HARMED

The State of Hawaii, under its Department of Land and Natural Resources (DLNR), and subsequently, DLNR’s Division of Forestry and Wildlife (DOFAW), has dispensed (dispersed) a known blood anti-coagulant (rat bait poison), throughout a region of its inventory of lands, knowing the poison has adverse consequences and negative effects on the pueo. This policy, to place a poison that harms raptors from the mountain to the sea, has been extended to government agencies such as the United States Military, and its landholdings, and the United States Fish and Wildlife Service, and its land holdings, and the State of Hawaii Forest Conservation Areas, under the justification and principle, that other endangered or threatened avian species, that are not predators of vermin, will benefit from this treatment.

HB1392, would establish a Habitat Conservation Plan HCP), specifically for the pueo, and would by its very creation, prohibit the dissemination of rat poison, by virtue that the preserve would be a dedicated place that caters to the interest of the pueo, and as such, not serve as the primary means, the management for, and the welfare of, other fauna/avian species that require, treatment. (The pueo thrive on vermin.)

Count II : HISTORICAL ACCOUNT OF UNIVERSITY OF HAWAII WEST OAHU PUEO

INHABITATION; THE NEGLIGENCE TO EXERCISE DUE DILIGENCE

In 1996, the State of Hawaii, as the landowner of the property where the University of Hawaii West Oahu (UHWO) campus is now located, had commissioned a third party to execute a Biological Survey for the purposes to take inventory for the presence of flora and fauna of interests to the State. The DLNR, with jurisdiction of the UHWO property in 1996, was notified by Dr. Ken Nagata (who performed the survey), that owl pellets were observed, and these owl pellets may have originated from the pueo. The pellets were turned over to DLNR to investigate, but DLNR declined to make a conclusive finding, if the pueo, by the evidence of these pellets, were inhabiting the property.

The 1996 Biological Survey was included as an Exhibit in the Final Environmental Impact Statement (FEIS) undertaken by PBR Hawaii Inc., of 2006 for UHWO. The characterization of the UHWO property per the 1996 Biological Survey, was described as a haven for wildlife, in that the property, with sixteen avian species, including the indigenous Black Crowned Night Heron, would serve as an, “excellent bird refuge.” However, in contrast, PBR Hawaii Inc., had portrayed in its findings of the FEIS, that the property was void of any threatened and or endangered species and further characterized the property as void of any habitat of significance that could serve any threatened or endangered species.

PBR Hawaii Inc., did not conduct its inventory for fauna/avian exercise during the sunset, and or sunrise period, when the pueo are active, and in addition, did not perform, or repeat its inventory during the wet and dry seasons, and rather, conducted the inventory for avian species in a few hours, in its totality. The inventory exercise to quantify for the presence of pueo inhabitation, was lacking in protocol to determine and satisfy, with certainty, an adequate and thorough search that represented the true characteristics of the property and how the features of the property, were conducive to the proliferation for and by the pueo.

Furthermore, no inventory transpired whatsoever, either by Dr. Nagata, or PBR Hawaii Inc., that searched for the federally listed endangered mammal, the Hoary Bat, even though the bat was witnessed by residents as utilizing the UHWO property. Dr. Nagata, also wrote, he never looked

for any avian species nest(s)- as it was not of party to his survey.

Undisputed, is the fact that DLNR, with full knowledge that State Archives contain historical accounts of the pueo as inhabiting in abundance, the territory from the shores of West Loch at Pearl Harbor, to the gulches within the Honouliuli ahupua’a, and UHWO geographically located directly between these pueo breeding grounds, DLNR, from the date it took over jurisdiction of the property at UHWO in 1996, and throughout subsequent property ownership transfers, through today, has yet to undertake any effort to search themselves for pueo nests at UHWO.

DLNR, as a party to the accepting agency for the FEIS accepting authority, Governor Linda Lingle, had signed a testimonial in 2006, that the findings of the FEIS, were an accurate representation of the property, even though, DLNR had never set foot on the property to quantify such, as truthful.

HB1392, would therefore, be the conduit to provide refuge, via an HCP, where the avian species, and the bat, of which were denied a satisfactory and thorough inventory, on the basis that no protocol was in place to adequately inventory for them, can lay their head under the protective wing of the pueo.

USFWS & DOFAW- on August 18, 2016, made the statement, recorded at a town hall meeting at UHWO, sponsored by State Senator Mike Gabbard, that no protocol was in place to adequately perform the exercise to satisfactorily conduct the inventory to quantify for the inhabitation of pueo. It was through the Project Pueo Population Study of 2017, that such a protocol had been developed and devised in tandem by USFWS, and DLNR, to adequately conduct the exercise to inventory for pueo inhabitation.

(With a proper protocol in place in 2017, DOFAW contractual hire, ornithologist Dr. Javier Cotin, upon his first visit to UHWO, had witnessed pueo, and pueo habitat, as present and established at UHWO.)

Now, therefore, be it the intent of the State of Hawaii House of Representatives, Twenty- Fifth Regular Legislative Session, that HB1392, be passed and brought to the attention of the Hawaii State Senate for consideration, and to act as restitution, for the unintentional lack of oversight for the wellbeing and health of the pueo, and hereby extends and affords to the pueo, considered sacred to the indigenous peoples of the State, this mechanism for relief.

EPILOGUE

1. 2015; pueo recorded on the border of the property at UHWO. UH Systems notified.

2. 2016; pueo recorded on the non-campus land (NCL) at UHWO. UH Systems notified.

3. 2016; five pueo nesting sites documented at NCL at UHWO by Native Hawaiian Cultural and Religious Practitioner, Michael Kumukauoha Lee. UH Systems notified.

4. 2016; two pueo nesting sites destroyed at NCL at UHWO as authorized by UH Systems.

5. 2017; one pueo nesting site destroyed at NCL at UHWO as authorized by UH Systems.

6. 2018; two pueo nesting sites destroyed at NCL at UHWO as authorized by UH Systems.

7. 2018; complaint filed with DOCARE on destroyed pueo nests. UH Systems notified.

8. 2016-2018; complaints filed with State Ombudsman Office- charge levied DLNR in non-compliance to HRS protecting endangered species and their habitat. UH Systems notified.

9. 2016-2018; complaints filed with State Ombudsman Office -charge levied UH Systems in violation to HRS Chapter 343, and Chapter 200, Title 11, Administrative Rules, that mandate a Supplemental Environmental Impact Statement (SEIS) shall be ordered to amend the FEIS to assess the new environmental condition (pueo) certified as inhabiting UHWO NCL. UH Systems notified.

10. 2018; State of Hawaii House of Representatives introduced HB2629 to establish an Endangered Species Laboratory on NCL at UHWO, defined at 150- acre pueo preserve. No hearing provided.

11. 2019; HB1569 introduced to place an HCP for pueo on the NCL at UHWO.

12. 2019; HB1392 introduced to have UH Systems sponsor an HCP off-property.

Conclusion, it can be argued, that HB1392 is the preferred mechanism, a compromise in which it offers UH Systems with the means to fully develop its property on the NCL at UHWO, and do so without executing the SEIS, and furthermore, acts as the vehicle to provide the pueo with the necessary remediation overdue, via the HCP established off of the UHWO property.

In his annual State of the State address at the Capitol, Hawaii Gov. David Ige asked lawmakers on Tuesday to consider the birth of the state’s first newborn of the year — Alekah Obra Garcia.

“In 2037, when she and her classmates graduate from high school, some of us will be long gone,” Ige said. “Perhaps one of your grandchildren will be among the Class of 2037. How will they view the decisions we make today? How will they grade the schools and education we provided for them?”
