Point= agenda of Berg is-  and hopefully yours too-  is to use the neighborhood board system to convince the board(s) that the EIS law must change- that within HRS, no requisites are required to mandate who does what when- - the ones doing the inventory just claim they were there- we never really know....and they are hired by the petitioner which is a conflict of interest in of itself- that they simply check off a box saying XYZ WAS ON PROPERTY and saw XYZ or didn't see XYZ. Then pau- walk away.

FactI know where the pueo nests are at UHWO and sadly, when they get disturbed- they will NOT GO BACK TO THE NESTS FOR DAYS!!!!!!!  Too many kids playing nearby trespassing doing odd things kids do-   and the dirt bikers wreaking havoc have that bird scared to death and in a constant panic-  it is on its last breath- I have filmed it the last three nights and have it on film but not publishing to youtube.- filmed in flight for it is not in the nests out of safety and fear....I think the two pueo I see daily are deciding right here and now if they want to settle in and make babies here-  they are seeking approval - and waiting for proper protection measures be put in place there at UHWO before laying eggs-  they are waiting-  they cannot risk laying eggs at UHWO and in three months or two days or three weeks- we don't know- the area is to be plowed up and paved over...which is the current plan/paving over the 300 acres where the pueo needs EVERY STITCH OF THAT 300 ACRES AND MORE before "buying in and settling down."

This is why the pueo are not in the nests daily -  they are super freaked out-  sad....they cannot even go to their nests...they need protection now. 

I am pleading with Kapolei board to pass a motion for a reso asking Senator Gabbard and DLNR /UHWO/UH Board of Regents place warning NO TRESPASSING signage up and now- and calling for a ORNITHOLOGIST to accompany me so as I can take them to the pueo to certify the pueo nests-   if no certification-  all is lost.....DLNR does not act on flyovers- period! 

1. Does EIS law mandate a certified ornithologist conduct the inventory and be on property from 6-9pm when the pueo can be seen? 
No

2.  Does EIS law allow the detailed report of who did the survey/inventory process log book recorded- to determine who by name and credentials did the inventory - does the law permit the public to see it-  when was John Doe on property - how long when and what tools were used?
No- all is kept confidential and kept from the public- this must change in my eyes and the report made public-!!!

CONCLUSION-   for all we know, the inventory for pueo could be performed by a hired hand from the checkout counter at Wal-Mart- no credentials/requisites to perform the inventory are required. Inventory could be done in one day or even two-minutes  - between 8am-4pm and not during sunset or sunrise hours- we have no clue.
Inventory could be done by one person when ten or more personnel are needed at one time to scour the property- but only one person looked- we have no clue- the law provides no guidelines, no mandates, no direction is provided.....no expertise is required....and thus- BERG's rant to get SENATOR Gabbard to act and write the bill to amend HRS /EIS process is the mission-

We must preserve and protect the bird now-  but in the meantime- use the "system" to enhance and improve the EIS law-  I seek the board's support to call for amending HRS to place mandates AND THE WHO WHAT WHERE WHEN HOW AND WHY for doing EIS-  and THE PUBLIC TO HAVE THE RIGHT TO ACCESS THE REPORTS conducted by the entity doing the inventory for the EIS.

  I am wondering if anyone has a link to the final Hoopili EIS – so I can look at this – and research it independently ?
I also need the rough maps showing where the last ones where located (say past 6 months) – so I see the overlap – or
the potential conflict involved. Do they follow a pretty standard typical flight path ? Or are they scattered all over
the Ewa plain.

I write to you to make a formal request that immediate action be taken - at least considered- by the Kapolei, Makakilo, Honokai Hale Neighborhood Board in which action would be to schedule the company that did the EIS for Ho'opili, that being- Rana Productions, to report under New Business how the EIS inventory was executed for determining whether or not particular flora and fauna were present on the property.

Fact:

At the August 18, 2016 Pueo Meeting @ UHWO
it was the opinion of a US Fish and Wildlife expert that
at Ho'opili, with its 1,500 acres broken down into ten segments by 
EIS consultant, Rana Productions, LTD., of which Rana was hired by
DR Horton to execute the Pueo inventory for their Ho'opili property, 
that the personnel doing the inventory, in order to do it properly, 
would have had to be present in all ten segments- at once.
Otherwise, "you are going to miss it." 

Fact:

Rana disclosed in the Ho'opili EIS process that it broke up the 1,500 acres into ten segments. 


Fact:

Rana will not disclose:

1.  Who performed the actual inventory? We have no names, and thus, no qualifications to scrutinize-  for it may be, that the personnel doing the looking for Pueo were not specialized in endangered raptors and the intrinsic nature of such bird species- and hence, did not know what to look for and when. 

2.  How many personnel were on the ground on-site performing the inventory?

3.  How long was the personnel doing the inventory in each segment-  what was the times, durations, and season the inventory was executed in each segment?

Fact:

I asked Rana for the information aforementioned-  Rana will not return calls and will not answer.

I asked Senator Gabbard to invite Rana to the Pueo meeting last month- Senator Gabbard exclaimed Rana stands by its report and has nothing to add and will not attend.

CONCLUSION:

Rana must be asked to appear before the general public and disclose how it searched for Pueo on the Ho'opili landmass.  This is where the neighborhood board comes in.  If you know the answers to how Rana conducted the inventory, how long at each segment, when, by whom, please come forward.  If you do not know the answers, you are hereby summoned to do your due diligence and see to it that the Pueo was not improperly disposed of and unjustly liquidated by a faulty, inferior, insufficient, flawed, and short-sided inventory (EIS) designed to fail that bird.  The old & current EIS process to conduct inventory to look for Pueo was designed to miss that bird- and the NEW PROTOCOL to go into effect to correct the errors and omission of a faulty inventory process - and the proof is that such new protocol is to be acquired by the State and to be implemented for the upcoming islandwide Pueo survey- why? For there was no proper protocol in play to execute the survey today in place!  They- DLNR and feds had admitted to not having the proper tools, and lacking information in general about the bird itself to adequately do it justice when researching it to determine where it lives.    If the authorities have to design a new protocol to find the bird, as they are now, doesn't that mean the old protocol, if in existence and was used, was faulty?

What should and can be done?  Paula Aila is public relations for DHHL-  she is emailed here for your contact-  she won't respond to me - same with Rep. Cullen- he represents the district where the dogs live-  Senator Espero too, he won't respond- all Hoopili supporters....this neglect and abuse has gone on for many months.....can you make headway and get the powers that be to save the pueo and friends and get the wild dogs removed?  

See, if the wild dogs are removed, the pueo and friends have a better chance of showing up and then putting a damper on development schemes....so to have the dogs remain, gives the politicians added insurance that wildlife will never get a chance again to get in the way of their cementing over the Ewa Plains plans.

This is in response to your email below in order that I may correct misinformation in you have stated in your email. 

A few months ago when you asked DHHL about a Pueo Sanctuary, we checked on this with DLNR.  We were informed that none exists in the State and conveyed that information to you.  I believe you also spoke to DLNR about this same issue and was provided the same response.

As for the recent information about dogs roaming on the DHHL lands, I have asked my Enforcement team to check on the area.  If it’s necessary, the department will inform the Humane Society of this activity.

Aloha All-
The signage of inquiry is/was for a bird nesting area-  your response was the bird nesting area was not for pueo-  so what is it for? The property was purchased/acquired by DHHL with this bird nesting site-  please see video-  this is also where the wild dogs feast...it certainly is a bird nesting area for stilts as they are there- plovers too etc., and if the dogs were gone, the pueo would have a shot at using this bird nesting site too. 

Housing is slated soon to be constructed on top of the bird nesting site signage of jurisdiction unknown.....your help to get clarification and history of the area /sign would and could be most advantageous toward the efforts of saving the pueo- its habitat- albeit the bird nesting sign not for pueo, its prime owl country.

Aloha Ms. Aila:  It is difficult to ignore the latest email and video of what seemingly is the further destruction and the demise of the beloved Pue'o is the area depicted in Tom Berg's.  More importantly, though is the danger these dogs now present to some unsuspecting hiker and/or vulnerable child(ren) who can go "exploring" as children do.  I join Senator Espero and ask what is DHHL planning on doing in light of what we know to be true.  As Chair of the Makakilo Kapolei Honokai Hale Neighborhood Board, I would be remissed if I did not have you notice that our Board recently passed a Resolution asking for preservation of the Pue'o and its habitat held in an August meeting at Kapolei Hale and still another August meeting hosted by Senator Mike Gabbard and Rep.Ty Cullen at the UHWO campus with several experts in attendance including Kumu Mike Lee.  There are many Hawaiians and Hawaiians-at-heart that stand fervently behind this Resolution and I would want to further discuss how we can help DHHL keep these creatures thriving in the area that they've known long before anyone of us was here to disturb its hale.  I sincerely hope that your DHHL land managers, land agents or security would prove (or disprove) the validity of Mr. Berg's renderings and if found to be true, act accordingly.  

If you've been the recipient of Mr. Berg's emails in the past, you will have been able to not notice his documentary, maybe to nauseum, but may I say that sometimes we must NOT focus in on the messenger, but focus instead on the message.  We, at the Neighborhood Board, have done this and I respectfully ask that you take the necessary steps to rescue the Pue'o from foreseeable demise if there is nothing done.  

In addition to this, I will ask that if it at all possible, a representative from DHHL be at our Board meetings held every 4th Thursday at 7 pm in the Kapolei High school cafeteria so DHHL related agenda items such as this will not go unnoticed or unreported.  It is my hope that we may form once again a communications channel for future items that affect the Homesteads in our area and that one of our biggest State departments is in tune with matters pertaining to our beloved communities and fast growing Second City.  

And as a Hawaiian and as a wife of beneficiary and Chair of the Neighborhood Board #34, I extend an invitation to you to attend our meeting(s), share your mana'o and have us match the face to the name.

If these people won't listen to and act upon the dire warnings about global warming, the extinction of species, and Etc. from the IUCN this week, then they will continue to listen to NO ONE except their puppet handlers or a lawsuit.

The Pueo has no voice in our broken system.

Maybe the SPCA can round up the wild dogs and either euthanize them or find a home for them on windward side to prevent the extinction of the Pueo, and give it a fighting chance.

Read it in today's newspaper-  Senator Gabbard loves Hoopili and wanted it to happen years ago....the chair of the committee that is to protect and preserve important productive land in use with water and great soils -  is Gabbard, and he did and does the opposite......time to make certain you are defeated in 2018, Senator Gabbard, in how you double crossed the pueo-  I thought you were for a supplemental EIS to be done there at Hoopili to search for pueo properly? Guess not....you are all talk- double speak. 

Who is at the helm of UHWO makes no difference-  when you got two faced sell out hypocrites talking out of both sides of their mouths making all the laws and ignoring the laws- 

Hey Senator Gabbard-  you do know I have filmed pueo at Hoopili within the last six months? That I have seen them repeatedly there-  yes-  the pueo was there-  they lived there-  and I begged for a supplemental EIS to prove it-   but you support bulldozing the pueo to death immediately-   you were apprised how flawed and with malice and by fraud that the EIS's were done by and for Hoopili/DHHL/and UHWO to omit the pueo by design-   and you know this-  the pueo is there-  you know it-  but you are a bad, evil two faced hypocrite Senator Gabbard to pretend to care about the pueo and yet you knowingly know you are killing it off at Hoopili with your cheering the Hoopili rape on.

I filmed the pueo there at 2am one night-  I got them on film-  but the film too grainy and dark to certify it-  AND I AM TRESPASSING!  But I saw them with my own eyes and sent the video to John Bond months ago to prove it as a safety measure....and many times I have sen the pueo fly out of a particular Hoopili ditch where the homes are going in right now!  ALL I ASKED WAS THAT A NEW EIS BE DONE SENATOR GABBARD-  and you sold out and showed your true colors. 

The worst enemy are those that pretend to care- watch them closely, as it is they who are the worst of the worst as they like you, Senator Gabbard, are pure badness to the bone marrow.  

You heard and saw and witnessed for yourself at your meeting last month how the FEDS and DLNR exclaimed there PROTOCOL TO SURVEY PUEO FLAWED-  THEY NEED A NEW PROTOCOL TO FIND AND PROPERLY INVENTORY THE PUEO because as stated, THE OLD WAYS WERE FLAWED AND DESIGN TO MISS THE BIRD ON PROPERTY WHEN DOING EIS! 

Sick, sad, and a sin- may the pueo haunt you to your death and beyond.

any kanaka Maoli resident of the ahupua'a can access this land without "permission" for cultural practice and others can be invited if they bring neeeded skills such as photography.  Do you have a copy of the Arch survey (AIS) for the parcel where the slab is? On the site above the freeway nearby is this unique rock slab and many rock formations marked by ribbons etc.....but today, the area has been purged clean of any markings and the ribbons gone. I am concerned the record has been purged.

Point-  the win win is that UHWO can still develop all of its plans and more so on the 900 acres remaining "untouched" above the H-1 freeway and then leave the 300 acres where the pueo are right now FOR THE PUEO- leave that acreage in situ, as is-  and utilize the 300 acre property to sustain and promote a world class on-site /endangered specie curriculum- an outdoor wildlife preservation lab- priceless educational opportunities abound in wildlife specie reintroduction etc. 




2.  I have video of the pueo at Hoopili but it is not certifiable -  I know it was the pueo, the camera knows it was the pueo, but the evidence on film not sufficient to prove to the authorities. I stumbled on this rock feature- see video link pasted below-  that in my opinion, has historical value/or educational purpose to preserve.  If Hoopili would not prosecute me for trespassing and permit me to bring my camera gear on property- I just know I can record the pueo for proper certification- it is there.....HEADS UP- DR Horton at Hoopili north central quadrant I call "Owl City"- well, Dr Horton has been bulldozing the earth not to plant crops- but to keep the pueo from substantiating a nest there-  yes folks- on two patches where I have seen the pueo numerous times just mauka of the rail line DR Horton has turned the soil to keep the tall grass from housing wildlife- the whole area blitzed....homes are not to be constructed here for another ten years out where the pueo and pueo habitat are- but they at Hoopili are making damn well certain no pueo can take hold there and so they are sterilizing the pueo habitat....shameful, just shameful. 



CONCLUSION IS-  the new chancellor needs direction - will you folks reading this email agree with me that the win win is attainable for all parties by having UHWO shift its auxiliary, recreational, and peripheral development to augment the university above the H-1 Freeway so as to give that pueo a home to call its own?

See-  if you said no- and instead think it best to have the pueo live in the hills instead on the 900 acres above the H-1 Freeway- -  and advance the development plan for UHWO as is on the 300 acres below the freeway-  this is the wrong answer....why? The spraying of experimental seed crop production Chemical City at Syngenta, Monsanto, Pioneer, etc., is so darn heavy and thick up there- no way does or could that pueo proliferate up there...and this folks, is why the pueo ain't there today- chemical spray to the max 24/7 365 days a year.   

Military does its controlled burns annually where the pueo could make a go of it too----  thus, no pueo inhabit any military property and the 1990 report inventory done by the state and feds back then validates such....and for ag land, the farms where active, have poisoned the pueo out- and hence, where we have a fallow patch of undisturbed prime Ewa Plain soil permitted to just "be," we have the pueo as a result of that -  and this land at 300 acres being "left alone" is teaming with wildlife.

Develop that 300 acres at UHWO- and the pueo has no where else to run and hide on the entire Leeward side....encroachment has permeated almost every stitch and blade of grass that bird needs to survive......and the new chancellor needs to recognize that and make the necessary steps in my opinion to abort developing the 300 acres and move instead on the 900 plus acres available mauka. 
A win win- it's right in front of our faces- pueo, development, the school, all get a good deal-  but will the chancellor dig it?

The bad news is that Franklin Kudo is Ben Kudo’s twin brother.  Ben was, and is, the top lawyer for Ho’opili in all of the LUC process.  Brothers sometimes are competitive and dislike what the other does, but usually not twins.  If he gets in, every last bit of Ho’opili will be built.  If Maenette Benham gets in, the pueo might be safe.

The University of HawaiʻiWest Oʻahu Chancellor Search Advisory Committee has identified three finalists—Maenette Benham, Larry Buckley and Franklin Kudo—for the position of chancellor and has invited them to participate in a final round of interviews.  (So they can negotiate their Golden Parachute.)
The campus community is invited to meet the finalists at a series of open forums on the UH West Oʻahu campus on Thursday, September 8; Monday, September 12 and Thursday, September 15. The forums are being held in the UHWest Oʻahu library in the ʻUluʻulu Archive Exhibition Space (located on the first floor, in the rear of the building).

Hi Tom,

By now, you realize that reason, logic, common sense, ethics, and morality have no place in government, only MOOLAH.    

As I have said all along, the only way to effect change is to have 100,000 people marching to and rallying at Honolulu Hale and the Capitol to sweep the bums out.

So grab a broom and start sweeping! 100,000 brooms going down Beretania / King street will get the attention of news media around the world, especially if done on Halloween, and could lead to both a national and international movement to take place every Oct 31.
