This "news" is APPLICABLE RIGHT NOW; FOR THE HARM that is being levied is to all people of Hawaii- and the harm IS CUMULATIVE:
This is the document your /our Honolulu City Council and Mayor /DTS advanced in 2008 to the FTA claiming:
Ho'opili is a wasteland /unproductive farmland......and hence, not one iota of any mitigation need be done regarding the rail plowing through it....and the results that such farms that will be lost to rail, not worthy of mitigation.
TRUTH is, that per the records within State of Hawaii Archives and State of Hawaii Dept. of Taxation- such acreage was the most productive in the entire State of Hawaii- (at Ho'opili specifically) garnering up to $100,000 to $200,000 per acre per year where crops can be rotated & the farmer reap 4-6 crops within an annual growing season and employing 10-20 people per acre/farm! Try that in any other State & the FTA/feds bought the lie, hook, line, and sinker....so sad.
In tandem- elected officials and the media have gotten away with murder claiming & posturing to the feds that this land- (of which was and still is today, the most productive farmland in the State)----but via our local government, they claimed such land was and is crap- worthless- characterizing it as a "Siberian Wasteland" to the FTA & slated for development.... "It is so unproductive," claimed the City, and backed up by the State.
This is the document itself! Proof the City ( & State) lied and the NEWS MEDIA COVERED up FOR THEM!!!!!! Have you seen this? You should!
POINT: The local media has and is covering up this fact- of which is that our media has gone so far as to make certain, no truth about the actual productivity of loss of this farmland shall be made public- they will never cover it (the truth, don't write about it etc.); par for the course in a corrupt town from newspaper to TV, to the bowels of government. For not one legislator has addressed the Rule of Law and the breach that still exists.
(For five others summoned by Dr. Dudley with expertise examined the same farmland & graded it "top of the line"- requiring mitigation--- and thusly, the harm is today, still being levied by those in elective office....All 100% of them....)
FTA/FEDERAL LAW states that any federally funded project that disrupts productive farmland, that such land be replaced! Be mitigated! But not here!
Read it and weep- seriously; for I am weeping we have such voters kept dumb by those in elective office and those controlling the news- and from such, that such collusion keeps a vicious cycle that puts lying thieves in the sacred halls of government....it's criminal really, criminal.

SENATOR WILL ESPERO was gracious enough to introduce a bill to address the EIS process whereby during the inventory exercise to determine the presence of endangered species- such as the pueo on the property in question, over 100 acres (per the bill), that such a process include a NEW MINIMUM of five days in the field to "look" for such endangered species----
You, Mr. Shigekuni, got class and are an honest man, and politely responded to me that for the 500 acres at UHWO- that the one doing the inventory only worked for two days in totality - April 15 & again on April 18, 2008 - for such exercise to see if pueo are on site- JUST TWO DAYS! WOW- OUCH! Admitting such inferior EIS process on your end - such took guts- thank you for being honest.
POINT: The bill Senator Espero wrote does not and did not address the TIME of day the inventory for the new FIVE DAY INVENTORY PROCESS FOR EIS- was to be done per SB570- meaning- the EIS/inventory for pueo NEEDS TO BE DONE FROM 4AM TO 6AM AND AGAIN FROM 5PM TO 9PMwithin those five days to adequately "catch" the pueo in action.
The pueo "ain't gonna be seen" by nobody from 8am to 4pm if that is when the person doing the inventory for pueo is "on the job."
Thus, in conclusion- Mr. Shigekuni- can you please reveal and share and release the information as to when the person who did the EIS "boots on the ground" actually was on site- meaning- did the April 15 and April 18 dates include the TIMES when pueo were being looked for---????? For if your company sent your guy out to look for pueo during business hours- between 8am and 4pm only, such is faulty from the onset.Getting this information from you is critical to this new Senate Bill 570- for the bill needs to be amended IN MY OPINION to include the NEW MANDATORY five day inventory process PER THE BILL - to also include the aforementioned CORRECT times the pueo is actually "out and about."So- QUESTION : Did your EIS for UHWO have the person doing the inventory look for the pueo before the sun came up- and after the sun went down? This info is vital.

Aloha All-
Answer I garnered from the EIS sent by Mr. Shigekuni (mahalo sir, for the quick response) - is pasted here below--- extrapolated out of/from this link to the document itself-
Summery:
No pueo seen- only looked in morning hours for it- for /over a two day spell- some observation was done by walking- some by drive through- that is all- that is it.....no other details or effort about the fact we have proof this 500 acres always had pueo- and still does- and the proof is a two-day "look see" that was done- was not sufficient- clearly the effort made back in 2005 was inadequate and faulty.....and cheated that bird. The "pueo" don't talk like other birds - oh my gosh.....field recordings ? As if that bird is going to hang around and "talk"......I am blown away this was the tool used....so if the bird don't make a sound for the person walking by- it's f$cked...the bird is determined to NOT EXIST.......rather than for example- trail cameras/motion detectors/cameras placed about the property etc....and the observation done at night- and over a full season....wow, just wow. They never looked after sunset......
I have had hundreds of encounters with the pueo- hundreds- countless......many within a few feet - many fly overs over my head within ten feet- and that bird rarely- rarely- rarely ever ever ever makes a peep= does not tweet tweet like other birds can and do......it is a quiet bird- not talkative....amazing. Hurts to read this. What a sham treatment that bird got. Crying shame.
