HAWAII ASKS FEDERAL JUDGE TO CLARIFY
THE SCOPE OF TRAVEL BAN INJUNCTION
HONOLULU – This afternoon the State of Hawaii asked federal district Judge Derrick K. Watson to clarify the scope of the travel and refugee bans in Hawaii v. Trump in light of Monday’s ruling from the United States Supreme Court.
On Monday the United States Supreme Court agreed to hear arguments later this year in appeals from two lower court decisions that had blocked certain portions of the travel and refugee bans from taking effect. The Court also made clear that the travel ban could not be enforced against foreign nationals who have a credible claim of a bona fide relationship with a person or entity in the United States, including those with a “close familial relationship.” The same standard applies with respect to refugee admissions.
In response to late guidance issued by the federal government as to how it intends to implement the bans, Hawaii’s motion asks the court to clarify that the federal government may not enforce the controversial bans against fiancés, grandparents, grandchildren, brothers-in-law, sisters-in-law, aunts, uncles, nieces, nephews, and cousins of people currently living in the United States.
Today’s motion also states that lawyers for the plaintiffs in both lawsuits, after the Supreme Court ruling, repeatedly asked the Trump administration to indicate how it intended to implement the bans. The federal government did not respond until the information was publicly posted, hours before the partial bans are set to go into effect.
Attorney General Chin said, “In Hawaii, ‘close family’ includes many of the people that the federal government decided on its own to exclude from that definition. Unfortunately, this severely limited definition may be in violation of the Supreme Court ruling.”
Hawaii’s motion states in part:
Hours ago, after days of stonewalling Plaintiffs’ repeated requests for information, the Government announced that it intended to violate the Supreme Court’s instruction. Beginning at 8:00 p.m. EST, it will apply the Executive Order to exclude a host of aliens with a “close familial relationship” to U.S. persons, including grandparents and grandchildren, brothers- and sisters-in-law, fiancés, aunts, uncles, nieces, nephews, and cousins. The Government will also exclude refugees who have a “bona fide relationship” with a U.S. resettlement agency—including refugees who already have a documented agreement with a local sponsor, and a place to live. And despite the Supreme Court’s claim that a foreign national cannot be blocked by the Order if he or she “credibl[y] claim[s]” a bona fide relationship with a U.S. person, the Government has instructed consulates to deny aliens entry whenever they are “unsure” if such a connection exists.
The Government does not have discretion to ignore the Court’s injunction as it sees fit. The State of Hawaii is entitled to the enforcement of the injunction that it has successfully defended, in large part, up to the Supreme Court—one that protects the State’s residents and their loved ones from an illegal and unconstitutional Executive Order.

The Hawaiian Kingdom allowed other ethnicities and nations to practice their holidays. Japanese had their festivals, the Chinese too... even British holidays were observed.
As much as we are occupied and want the U.S. to respect and honor our treaties we as Kanaka should too. Most treaties with the U.S. have the phrase "perpetual friendship". Perpetuity means forever. If our treaties, bilateral contracts are still in effect, then as Kanaka Maoli of an occupied nation we should show Americans our friendship, and kill them with kindness and the Aloha only we have - regardless of what they have done in the past to us. Yes, it's upsetting but we have to forgive. How can Hawai'i be totally independent when we harbor resentments, towards a country that acts like an anchor to our souls with grief and pain?
Forgive them. Not for them, for us. Pray for them.
Think about all we have in common, in the Kingdom, a democratically elected government of the Kingdom was usurped at the hands of the 1%. 13 men in a country of 140k people, stood in front of Iolani Palace proclaiming they were the new government as unelected officials.
If you look at America right now how different is it from the Hawaiian Kingdom and our Coup'D at? Multinational Corporations manipulate congress at every level in America, to the point where corporate bills get passed 60% of the time and bills from the general public get passed 30% of the time. Statistically, that is not a country for or by the people. Statistically, their democracy is now an oligarchy. The 1% parading around as their government.
We should have empathy towards America... since if anyone knows the feeling it is us. May I remind you we sent our own citizens from Hawai'i to fight on both sides of the civil war.
We have fought and died alongside America. America and it's flag have been overthrown today, by multinational corporations and the interests of the military complex. No different than how Chiquita went into Latin America overthrowing their governments for cash crops and U.S. military installations, which are the strong arms of corporate interests.
Most Americans wanted independence for Hawaii. Most in congress voted against annexation stomping out any hopes of a treaty. Congress ratified a 2/3s vote against a treaty. Grover Cleveland through the Lili‘uokalani assignment that affects every current and future administration is to return the Kingdom of Hawai'i after a thorough U.S. investigation the Blount report declared what happened to us in Hawaii was a mistake. We even got an apology and admission in 1993 without reparations but what did the American Native get for their genocide? There were just a few in congress that worked for the 1%... not all Americans are our enemies. It's the Americans that are treasonous to America like Dole.
The other 99% of Americans have 99% things in common with Hawaiians including our DNA. We are all part of one human family.
The father of American Political science questioned the constitutionality of how America could acquire the Hawaiian Islands...
But the constitution is as worthless as toilet paper when your government is no longer ran by a democratic process. What does the opinion of the 99% have to do with the 1%?
Most voter fraud is questioned at 3%, in these recent elections over a dozen states had a 12% or higher probability of vote fraud.
Americans have lost their governments and freedoms just as we have. I say yes to allowing them to celebrate their independence... maybe they will realize what their founding fathers fought for and kick out the multinational insurgents that control their freedom.
Hawaii's independence has a lot to do with America's independence and their control over the government. We are all connected.
11 Million Americans voted for a president who was against multinational corporations and bankers... who control their freedoms... 11 million feel their government is no longer for or by the people. That's 11 million Americans that have a lot in common with our movement. Is Dole not a multinational corporation? Who controls America today? In a recent poll, most Americans do not trust their government.
I've been honest to every American about Hawaii's independence and why I stand for it... even to those who have been deployed to Iraq, as a Hawaiian transplant living on the mainland... believe it or not. When explained correctly, most Americans, even ex-military, I have spoken with, agree that Hawai'i should be returned and what was done was wrong. They always have a very disgusted look on their face... and are ashamed of what their governments have done to such a peaceful and loving island nation.
The enemy of my enemy - is my friend. It's the 1% who commit crimes under the disguise of American democracy that are treasonous to their own country. We are not American's, that doesn't mean America is our enemy.
Article 1 of the Hawaiian Kingdom's first of 5 treaties with America states:
"There shall be perpetual peace and amity between the United States Peace and the King of the Hawaiian Islands, his heirs and his successors."
Remember America was the first country to recognize Hawaii's independence, just as Hawaii was the first to recognize Japan's.
As a neutral country, we have no countries that are enemies. That's what neutrality means. In fact, countries at war historically sought Hawai'i's shores for refuge to repair their ships. We are the city of refuge of the world. We are Hawai'i!
