Dear Ombudsman,
Would it not seem logical and of proper, consistent protocol, for the property owner that performed its Environmental Impact Statement for the Honolulu Authority for Rapid Transportation (HART), that it too, just like the Chancellor at UHWO, Dr. Ching, be in compliance to the endangered specie law and when apprised of a "new condition," such as pueo on the property, be required to investigate?
Shouldn't HART be performing its due diligence and exercising resolve to conclude the"new condition" applicable for triggering a Supplemental Environmental Impact Statement be investigated- whereby when the original EIS performed, concluded no pueo were occupying, utilizing, nor frequenting the property whatsoever in its entirety- ?
And now, the videos are evidence- they prove the earlier assessment by HART when conducting the exercise for the inventory to document pueo to be faulty, flawed, and inaccurate for we do indeed, have pueo on the scene, on the property, and exercising usage of the territory under HART's domain directly. The presence of the pueo cannot be denied- and henceforth, being a new condition, cannot be dismissed by the rule of law.

Some of the UHWO fields were sprayed/doused, saturated, permeated, coated to the max recently with pesticides and other unknown chemicals - and the rail corridor offers land with uncontaminated food sources that the pueo can be observed frequenting daily.

JUSTIFICATION FOR OMBUDSMAN- HART HAS NOT RESPONDED TO ANY PUEO OBSERVED/SIGHTED ON ITS PROPERTY:
The owls utilize a dormant elevated railroad track right of way along a roadway identified as Kualaka'i Parkway in Honouliuli (East Kapolei)- this area is utilized each morning and afternoon by the pueo as is evident in numerous recordings over many months- and when the train is in operation, this prime, vital feeding time for the pueo between 4-6am at this location to survive, will be severely impacted by the new parking feature, rail station, bus stop, and other hub activity associated with the rail transit station's activities/noise.
It is obvious, that the pueo in the very near future, will not be able to hunt and traverse over the thoroughfare crossing from UHWO to West Loch's Honouliuli Wildlife Preserve as it does now and occupy the East Kapolei Rail Transit Station area for food.
Eventually, UHWO is to develop the 300 acres that the pueo are nesting at currently- so what is to happen to these pueo?
Why hasn't HART performed a Supplemental Environmental Impact Statement for the pueo? The presence of the pueo, is certainly, a new condition of a feature now present and utilizing the property under HART's jurisdiction- and thus, a Supplemental Environmental Impact Statement is in order- just like being pursued at UHWO for its pueo activity.
Please, Ombudsman, make the inquiry with HART regarding this matter if warranted - your assistance and cooperation is greatly appreciated.
Please note, the pueo filmed September 27, 2015, over a year ago, was brought to HART's attention- but HART has never responded. With the subsequent evidence, compliance to summon a ornithologist to the property appears to be in order.
