Aloha Sierra Club-
Your backing up DLNR, and claiming no pueo inhabited the UHWO property-
proves your organization is laden with bias, political favoritism, and bought
off - more over, dishonest.
I want every donor to your organization to know- you were contacted hundreds of times
over three years to defend the endangered pueo under attack at UHWO- and you refused
to respond.
Evidence:
You attacked Rep Cabanilla - the only one TRULY defending the pueo- and spent funds to have her defeated- unelected.
And the Sierra Club PAC gave money to her opponent - Matt LoPresti, who advanced a false narrative that the pueo
at UHWO do not, and did not exist. Yikes.
This adds to the evidence you at the Sierra Club, are acting in bad faith- 100%.
The evidence DLNR acted with malice - and actually conducted a fraudulent survey
at UHWO is overwhelming....DLNR to this day, says UHWO contained no habitat
that served any endangered species......where is the Sierra Club? In hiding, rather,
defending DLNR!
Your leadership is the problem- not your donors- donors expect
you to act when notified illegal activity to harm an endangered species
has taken place- instead of helping, leadership at Sierra Club chose to deny the evidence
that I and others presented - the pueo as existing at UHWO- auwe!

Aloha Senator Kurt Fevella,
DLNR has until October 4- to answer OIP complaint: please see attached.
Senator Mike Gabbard has been responding to me on this- but has asked
I deploy my inquiries with you- as you Senator Fevella are my Senator, not Senator
Gabbard. I had to resort to Senator Gabbard because you have never responded to my dozens
of emails on the pueo at UHWO- ever- you have never sent me a message other
than once, or twice, your office staff responded "Received" when I threatened to expose you
ignoring me at a Ewa Neighborhood Board meeting- your conduct is and
was rude- and disturbing- now I ask you, to justify why you have refused
to offer any comment whatsoever on the conduct of DLNR at UHWO regarding
the pueo and bat that used to live there.
At this time, DLNR has refused to address the inquiries as proposed to them
on the taxpayer funded Breeding Ecology Survey for Pueo at UHWO.
I humbly ask you to stop your rude treatment of me as your constituent, and
actually answer the email sent to you.
HISTORY:
The FEIS for UHWO was accepted by Governor Linda Lingle
in February 2007.
DLNR submitted a letter to Governor Lingle (document is in FEIS)-
--- that the protocol used to execute the Biological Survey for UHWO
was satisfactory, and thereby approved the inventory process results conducted
by consultant PBR Hawaii- that stated, "No endangered species
habitat exists on the property. No endangered or threatened species
inhabit the property."
Senator Fevella- I and many others proved the pueo was alive and thriving at UHWO
and that DLNR has acted with malice. I and many others wholeheartedly disagreed
with PBR's assessment the property was a wasteland.
Conclusion by PBR was the entire 500-acre property can be developed as planned
because PBR Hawaii stated that the property "contained no habitat
that could possibly serve any endangered or threatened species (excluding
the Red Ilima)."
In other words, PBR characterized the property as a "Siberian Wasteland."
My question to DLNR is - was set up this way:

Yet, DLNR wrote to Governor Lingle, that the property's characterization by PBR was
accurate- well orchestrated- thorough. But we know per the FEIS, that PBR stated it could
not cover the 500-acre property adequately and therefore, instead of walking around in the tall
grass to look for the ground nesting pueo that makes no physical nest- just lays its eggs right in the dirt-
in the grass- get this, PBR rather DROVE AROUND THE CANE ROADS to conduct the survey.
I wrote to DLNR to explain its contradictions in that- how could DLNR claim to the Governor that the property
was properly examined for endangered bats and pueo, when the protocol to do such, was not followed, at all?
DLNR is is hiding and won't address this.
When Senator Espero got wind of how dirty PBR conducted the inventory, Senator Espero introduced SB570
to require requisites in the survey exercise for future FEIS products--- requisites that would actually follow science- and the
recommendations by science, that to conclude a property void of any endangered species habitat, the observer
needs to follow protocols such as actually walking the property- meaning a "drive through" the property
is not adequate- looking for pueo on 500-acres in just six hours total, in a week's period, not satisfactory.
So- the simple question for DLNR is-
"How can you state the inventory exercise for UHWO as conducted by PBR Hawaii
was thorough, adequate, satisfactory, and met all the requisites when the inventory exercise never included
any inventory for the bat- and failed to deploy DLNR's own opinion of what an adequate survey is for detecting
pueo?"
DLNR approved a methodology to look for pueo- by sitting in a car- or driving through the property
staying on the cane roads to observe for pueo that hide in the grass - pueo do not make nests in trees.
Pueo don't fly out of their nests from the ground when a car passes by 200-yards away from it- as PBR
did its survey for the property- expecting to locate pueo by use of car 200-yards away from actual
pueo habitat that did exist on the property.
No one per PBR's own admission, actually examined the entire property- they rather conducted the
exercise partly, by car.......driving on roads.
PROOF OF MALICE:
In 1996- when DLNR had jurisdiction over the property- they hired a consultant to examine the property-
and the examiner then in 1996, stated that- "We found owl pellets- and turned them over to DLNR to examine
if derived from barn owl, or pueo species." DLNR refused to examine the pellets-
The same 1996 report on the 500-acres stated the property was teaming with avian wildlife- and I quote:
"The property would make an excellent refuge for birds as we detected over 18 species" - with the indigenous
Night Crowned Black Heron present. The 1996 survey though- prohibited the examiner from recording
nests- the survey was just to record what was flying about and roosting on the property, or on the ground-
and the researcher states in their report- that they never went to examine where the owl pellets came from- expecting
DLNR to follow up- DLNR did not.
I find this act by DLNR to be an act of Willful Indifference, Administrative Bias, Institutional Prejudice,
and gross negligence of their statutory duty- per HRS.
Please Senator Fevella, can you please forward my email here- and contact DLNR to answer?
If you watch this video- it is obvious, pueo were there- but DLNR and UHWO in tandem with
the State Attorney General, have advanced a fraudulent, and faulty representation of the true
characteristics of the property- videos don't lie, people do.

of Perpetual Help in Ewa Beach- please Senator Fevella, don't spit
on his grave with your non-action, your refusing to assist- and rather
offer respect for this man, and honor him, by exposing the fraud DLNR
orchestrated at UHWO- for Mike Lee told the truth- and we have the
evidence DLNR with UH and the State Attorney General acted with
malice to do harm, knowingly and willingly to an endangered species.

What a great article/theme this would be to expose-
Trump is trying to save wildlife from the insanity of windmills-
and the Dems are actually fighting Trump so the Dems can kill
more endangered species.
What DEMS are heralding as a sound energy
policy- sounds more like an extinction policy
for endangered and threatened species.

State of Hawaii to have a waiver to the Federal

The decision on September 20 to kill bats, pueo,
and other endangered birds via wind farm operations
was applauded by State Senator Mike Gabbard- a Democrat,
who supports the addition of solar and wind farms
to blanket our landscape - even on sensitive areas
utilized by endangered and threatened species.
If I am wrong- name the one piece of legislation passed into law,
that any legislator in Hawaii supported that puts the needs of endangered species
OVER the rights of wind and solar farms? Correct, there are none.
If you value open space, wildlife, a natural vista of greenery,
kiss it all good-bye with Gabbard as chair of the committee
that oversees environmental issues in Hawaii's State Senate-
or any Democrat for that matter- not a one gives a hoot about
wildlife when it comes to going "Green."
If you love Hawaii's wildlife, please stop voting for Democrats.
HAWAII'S DEMOCRATS running the show don't value pueo,
don't value bats- don't respect HAWAIIAN PEOPLE with aumakua-
If Democrats did respect Hawaiian people who have aumakua, Democrats and
their DLNR they control, would fight to protect the bats and pueo-

all aumakua that get in the way of any wind or solar farm. FACT.
The Hawaii Clean Energy Initiative requires our hills, mountain
sides, and open plains, gulches, even farms with non-grade A soil to be purged of
wildlife, and replaced with solar and wind farms. This is a FACT. Undisputed, period.
To have the Hawaii Clean Energy pan out,
it has to "eat the landscape."
If you are like me, you know the truth that today's use of gas
and coal by USA is cleaner for the environment--- you know that
Hawaii can save and protect its wildlife and keep its open space
and beautiful landscape preserved for future generations by aborting
Hawaii's Clean Energy Initiative and using other technologies
to produce energy- such as ocean wave power.
It ain't 1970 anymore- we don't have acid rain like we do because
the gas and coal industry in USA cleaned up its act- but Democrats

to save the planet- China and India are the polluters- go after
them, not our bats and pueo!

regulating the protection of our endangered species- you have
Title 16 U.S. Code § 1539; Section (a) (2) C)) at your discretion to
revoke the Incidental Take Permit (ITP) for the four wind energy projects in
Hawaii.
Please consider revoking the ITP for the wind energy projects- I have
attached a letter for the Department of the Interior to use to assist you
consider justifying the revocation.

"The most direct way to address climate change is to keep fossil fuels in the ground."
Members of Save Our Illinois Land, Indigenous Environmental Network, National Nurses United, Sierra Club, and Extinction Rebellion joined residents in a rally protesting against the doubling of the pipeline.
In June, Energy Transfer Partners, the parent company behind the Dakota Access Pipeline, put in a request to the U.S. Army Corps of Engineers to double the capacity of the DAPL. Currently, the pipeline sees 570,000 barrels of crude oil per day. The company wants to increase this to 1.1 million.
The proposed expansion would mean new construction projects throughout the state of Illinois to install additional oil pumping stations. The pipeline currently runs from North Dakota, through several states, and ends in Illinois.
“The most direct way to address climate change is to keep fossil fuels in the ground,” one protestor told WBBM780.
The DAPL project has been one of the most controversial and opposed pipeline projects in history. Since 2014, Indigenous and environmental groups have fought hard to halt its completion and now its expansion. In 2016 the Standing Rock Sioux sued the U.S. Army Corps of Engineers, then in 2017, the U.S. Court of Appeals for the District of Columbia Circuit rejected Standing Rock Sioux’s request to stop the pipeline construction. Since the beginning of its operation in 2017 the pipeline has seen at least 10 oil spills.
Earlier this year the tribe renewed the fight against the DAPL by asking a federal court to throw out the environmental assessment of the pipeline’s potential impacts, claiming the Army Corps of Engineers “never engaged with the Tribe or its technical experts, shared critical information, or responded to the Tribe’s concerns.”
