Statement on Professor Kaleikoa Ka‘eo
(Honolulu,HI) The Native Hawaiian Legal Corporation is more than baffled at the underlying message in the Court’s decision... yesterday to issue a bench warrant for Professor Kaleikoa Ka‘eo based upon his failure to appear for his English trial despite his actual physical presence in the courtroom and his willingness and readiness to proceed. The Court essentially ignored Professor Ka’eo’s physical presence based solely on his sincere desire to proceed and present his case in Hawaiian.
(Honolulu,HI) The Native Hawaiian Legal Corporation is more than baffled at the underlying message in the Court’s decision... yesterday to issue a bench warrant for Professor Kaleikoa Ka‘eo based upon his failure to appear for his English trial despite his actual physical presence in the courtroom and his willingness and readiness to proceed. The Court essentially ignored Professor Ka’eo’s physical presence based solely on his sincere desire to proceed and present his case in Hawaiian.
The Court’s action yesterday is inexplicable and nonsensical given the judiciary’s ultimate obligation to ensure the mere appearance of prejudice has no place in this sacred institution. Ultimately, the refusal to acknowledge Ka‘eo’s presence to the point of issuing a bench warrant for his failure to appear is nothing short of absurd.
Although we learned today that the Court recalled its bench warrant and has set a further hearing date for February 21, 2018 in an apparent reconsideration of its action yesterday, we are greatly disappointed that we live in an age where this situation occurred in the first place and we will wait to see how this matter unfolds at the next hearing.

The Hawaii State Judiciary will allow the use of Hawaiian language interpreters in courtrooms when participants in legal proceedings “choose to express themselves through the Hawaiian language.”
The new policy was announced today, following a widely reported incident in which a Maui district judge issues a bench warrant for a defendant who chose to speak exclusively in Hawaiian in his courtroom.
Samuel Kaleikoa Kaeo, an assistant professor in Hawaiian studies at the Universit...y of Hawaii Maui College, appeared in Maui District Court on Wednesday on a disorderly conduct charge stemming from his part in an August protest against construction of the Daniel K. Inouye Solar Telescope on Haleakala.
The new policy was announced today, following a widely reported incident in which a Maui district judge issues a bench warrant for a defendant who chose to speak exclusively in Hawaiian in his courtroom.

Kaeo opted to conduct his defense in Hawaiian, prompting Judge Blaine Kobayashi to issue a bench warrant on the grounds that the court was unable to determine whether the defendant, Kaeo, was present.
Kobayashi rescinded the warrant without explanation the following day.
In announcing the new policy yesterday, the Judiciary said it would develop implementation procedures and solicited public input.
