Dear Mr. Shepard and Mr. Parsons,

Could you please explain to me why the Kanaka are still being considered as Americans after President Cleveland Ordered that the Queen be reinstated?

Could you also please explain to me why the Kanakas have their own Department of Interior Category instead of being part of the Bureau of Indian Affairs?

Are there other “Indigenous People” who have been separated out of the Bureau of Indian Affairs?” If so, could you please direct them to me?

It seems there are problems which need to be addressed.

I live very close and would appreciate a meeting to discuss issues which are confusing me.

Aloha,

Hawaii is Region IX in FEMA.

My understanding is that Kanaka are not Federally Recognized. I am not sure how that can be since the Department of Interior has Kanaka listed.

It seems to me, again, that the Kanaka are getting none of the benefits of the Federal Government, and seem to be stuck in a no-man's land.

IF FEMA did come to Hawaii then there would be an accounting of who owns what land.

I think that Quiet Title and other land grabs would be exposed.

I don't think the Mayor or Governor would allow that.

Trump might not, either.

I think it is worth the effort to find out about FEMA and work to get your lands restored.

Thanks for the Information. I agree with what you have sent and the danger these overfilled reservoirs create.

The Kanaka can file for FEMA.

The Governor and Mayor will

not because when FEMA comes in they will do a complete Title Search.

This will expose the illegal land (Quiet Title) and seizing of the land.

When the Kuleana Lands are restored all of this "stuff" will stop.

FEMA has an office in Hawaii, and our team has been in regular contact with state emergency management officials. We have specialists working with the state and we now have two individuals on Kauai to offer technical assistance, but in support of state and local efforts.

Please understand that FEMA is not in charge of disaster response. We support state and local efforts. I am not indicating that there are not individuals, businesses and communities that have not been significantly affected when I say that we are not aware of unmet critical needs. Are you aware of people who are stranded or don’t have access to food or water? Those are the life-saving and life sustaining needs that could expedite the regular disaster review and request for assistance process.

I am striving to respond to your questions openly and honestly, but I ask that you not take my responses to you and use them for other purposes. Also, I have planned commitments for most of the day, so if you write again, my lack of a response is not because I am not willing to continue communication but due to other obligations that have been in place for weeks.

I find it interesting that FEMA has been informed that there is no immediate need.

I have asked FOIA FEMA for any emails or other forms of communication from the State of Hawaii and the County of Kauai why there is no immediate assistance.

Your bridges are cracked, and missing and roads are impassible due to horrific mud slides.

Sink holes are appearing causing more damage.

People houses are under four feed of water, destroyed, and in the ocean flooded.

Water and electricity are gone.

Reservoirs are over-flowing causing possible breaches.

Buffalo running loose attacking people!

What part of what happened during the last week is under control by Hawaii?

The Kanaka suffer the worse and as usual you do not care.

Is that the idea, force more Kanaka off of their land, so rich people can buy or Quiet Title?

I have found other FEMA assistance to other "Tribes" in amounts not close to what the Kanaka need from this last storm.

The people in charge of the "Tribes" got assistance in amounts less than what the Kanaka need.

I have forwarded the information to the Kanaka.

The Kanaka have their own "Rating" in the DOI. I am trying to determine why.

The DOI NHO will not answer my questions nor phone calls.

This is the beauty of living a few miles away from the DC offices.

I can go in and "bug" people and get answers.

Obviously, the Kanaka who have to cross an ocean and often do not have the money cannot personally "engage."

In my mind, they either get full DOI BIA status and the protections that other "Indigenous People" have, or they do not.

Again, I am trying to determine why the Kanaka are not part of the DOI BIA.

The Kanaka are being forced out of their islands due to illegal means, according to what I can find.

They have Alodial Title, Royal Patents, and Land Grants, which should protect their lands, but these lands are illegally taken from them.

Even Quiet Title actions by the Mormon Church are being used in Laie Valley for 7,000 acres. This is not the actions of a Church, in my mind.

Rich people are using Quiet Title actions with partition against the Kanaka who cannot fight back. Then the rich people are taking the Kanaka land for a place to "retreat." The Kanaka need the land to farm and live.

The Kanaka are not lazy and "Squatters."

They are having their rights, including the rights for FEMA assistance, denied them.

They have no where to live and have lost their lively hood when the land they had is in the ocean, their houses flooded, their cars destroyed, and the boats they used to use are on the bottom of the bay.

Where is FEMA then?

Mark Z. fenced land that legally on the books belong to Kanaka. He "bought" land under a false name. These frauds, of course, will void, but need to be exposed.

I believe that is one of the reasons that FEMA is not being asked to come in right away.

This is part of what I am working on to help restore the Kuleana Land to the Kanakas.

Other Tribes are less in need, according to my thinking, than the Kanaka.

The Kanaka land is more desirable than the Cherokee, Ute, and Navajo land, but it is still Kanaka Kuleana Land.

Perhaps you are wondering why federal disaster assistance is not available? The President declares disasters after a governor requests help, and the request must certify that help requested exceeds as the state and local capabilities. That certification almost always follows a joint preliminary damage assessment. Because it has continued to rain through the week. The assessment will not begin until Sunday.

FEMA is working with the state and the processes being followed now are typical. We are not aware of any life saving or life-sustaining needs that are unmet at this time so we are working with the state as we do with most states at this phase of the disaster response.
